By Authority: L. F. JOHNSTON, Commonwealth Government Printer, Canberra.

Overview

The Naval Defence Act 1910-1949 was enacted to address the need for a coordinated and structured approach to the defence of Australia's maritime borders and interests. This Act provided the legal framework for the establishment and operation of the Royal Australian Navy, including the regulation of naval establishments and the determination of naval personnel's pay and conditions. The problem or gap it addressed was the absence of a comprehensive legislative instrument governing the Royal Australian Navy's administrative, operational, and personnel matters. The enacting body was the Parliament of the Commonwealth of Australia, which aimed to ensure the effective and efficient management of naval resources and personnel through this legislation. The policy objective was to establish a robust and well-regulated naval force to safeguard Australia's maritime sovereignty and interests.

Scope and Application

The Naval Establishments Regulations 1951, made under the authority of the Naval Defence Act 1910-1949, pertain to the amendment of rates of pay for various positions within the naval service. This regulation applies to personnel employed in the Commonwealth of Australia's naval service, including officers and ratings, across all naval establishments and related facilities. It sets forth specific remuneration structures, including minimum and maximum pay rates as well as annual increments, for a broad array of roles such as Assistant Overseers, Draughtsmen, Naval Constructors, and various other technical and support positions. The geographic reach of these regulations is national, as they apply to all naval personnel employed by the Commonwealth of Australia. While the regulation primarily focuses on pay and increments, it does not explicitly mention any exclusions, exemptions, or thresholds beyond the outlined positions and their respective pay scales. The regulation extends its application through the specified amendment to Regulation 43, thereby affecting all personnel within the designated positions as listed in the updated table.

Key Provisions

The main operative sections of these regulations involve the amendment of the Naval Establishments Regulations concerning rates of pay for various positions within the naval service. Regulation 43 of the Naval Establishments Regulations is specifically amended, replacing the previous table of pay rates with a new table detailing the pay per annum and annual increments for numerous designations of positions within the naval establishments (Reg 43). These positions range from Assistant Overseer to Storehouse Assistant, with pay scales varying based on the grade and experience of the employee. The obligations imposed by these regulations are primarily concerned with ensuring that the revised pay rates are correctly implemented and adhered to across the naval service. This involves updating internal records, payroll systems, and any other relevant documentation to reflect the new pay scales. Employers within the naval service are required to ensure that all employees are compensated according to the rates specified in the amended regulations, taking into account their specific roles, experience, and any applicable annual increments. Failure to comply with these regulations could result in a range of civil and criminal consequences. While the specific offences and penalties are not detailed within the text of the regulations themselves, non-compliance with pay rates as stipulated by law could potentially lead to disciplinary action against employers, including fines or other penalties. Additionally, employees who do not receive the correct pay in accordance with these regulations may have grounds to pursue legal action against their employer for breach of contract or wage theft, potentially leading to compensation claims. It is important for both employers and employees within the naval service to be aware of and adhere to these pay regulations to avoid any legal repercussions.
