Overview

The Statutory Rules 1942 No. 414, issued under the Naval Defence Act 1910-1934, represents a legislative instrument designed to amend the Naval Establishments Regulations, specifically addressing the rates of pay for various positions within the naval defence sector. Enacted by the Governor-General, acting on the advice of the Federal Executive Council, this regulation was introduced to address discrepancies in compensation for personnel within the naval services. The policy objective behind these amendments is to ensure equitable and structured remuneration, reflecting the roles, responsibilities, and experience levels of the personnel within the naval defence force. By providing a detailed table of positions, grades, and corresponding pay scales, the regulation aims to offer clarity and consistency in salary structures across various naval roles.

Scope and Application

The regulation under the Naval Defence Act 1910-1934 pertains specifically to the amendment of the Naval Establishments Regulations, focusing on the rates of pay for officers and employees within the naval service. This regulation applies to all personnel occupying positions within the naval defence sector, which includes various roles such as armament artificers, assistant inspectors, and draughtsmen, among others. The scope of this regulation is limited to the personnel and positions specified in the amended table of rates of pay. The geographic reach of the regulation is national, as it is a Commonwealth instrument, thus applicable across Australia. The regulation does not explicitly state exclusions, but it is implicitly understood that it applies only to those roles and personnel listed within the amended regulations. The regulation may be extended or restricted further through subordinate instruments, although such provisions are not detailed within the text itself.

Key Provisions

The main operative sections of the regulation, as detailed in Statutory Rules 1942, No. 414, involve the amendment of Regulation 43 of the Naval Establishments Regulations (section 1). This amendment concerns the rates of pay for officers and employees within specified positions and grades, as outlined in the regulation. The regulation replaces the previous sub-regulation (1) with a new table detailing the pay rates, increments, and minimum and maximum annual salaries for various positions. Each position is assigned a grade and a corresponding pay range, with some positions also indicating specific increments per annum (section 2). The obligations and requirements imposed by this regulation are primarily administrative in nature. It mandates that officers and employees occupying positions listed in the amended regulation are to be paid according to the specified rates. This includes setting minimum and maximum annual salaries, as well as detailing the increments for certain positions. The regulation ensures that all eligible personnel are compensated according to their designated roles and levels of experience, as evidenced by their age or grade. Additionally, the regulation outlines specific pay rates for different categories within the same position, such as the various grades of Assistant (Adult) and Youth at different ages. The regulation does not explicitly outline offences, penalties, or consequences for breaches. However, non-compliance with the specified pay rates could potentially lead to legal consequences under broader employment or defence regulations. If an employer fails to adhere to the stipulated pay scales, it could result in disciplinary action, legal disputes, or other administrative penalties. The exact nature of these consequences would depend on the specific circumstances and applicable laws at the time.
