Overview

The Statutory Rules 1947 No. 188, made under the Naval Defence Act 1910-1934, were enacted by the Governor-General in Council to amend the Naval Establishments Regulations. This legislative instrument addresses issues related to the adjustment of pay rates for various positions within the naval defence sector, as well as variations in salary due to changes in the cost of living. These regulations were designed to ensure that personnel within the naval defence force are compensated in line with both their roles and prevailing economic conditions. The amendments aim to bring the pay scales for specific positions up to date and to adjust salaries based on the cost of living, as measured by an index number set for the six months ended 30 September 1946. The intent behind these changes is to maintain fair and competitive remuneration for naval personnel, thereby supporting the overall efficiency and morale of the naval defence force.

Scope and Application

The Statutory Rules 1947 No. 194, made under the Naval Defence Act 1910-1934, pertains to amendments in the Naval Establishments Regulations, primarily focusing on the rates of pay for various positions within the naval service. These amendments affect individuals employed in the Australian naval service, specifically altering the remuneration for certain roles and introducing new positions. The scope of this legislative instrument is confined to the Commonwealth, applying to personnel within the naval defence sector, and it does not explicitly extend to state or territory employees or entities outside the Commonwealth naval framework. This regulation does not explicitly outline exclusions or thresholds but modifies the existing remuneration table by inserting new positions and adjusting or removing others. The amendments further include adjustments to salaries based on changes in the cost of living index, reflecting the economic conditions of the time. The application of these regulations is subject to the overarching framework established by the Naval Defence Act 1910-1934, which governs the administration and operations of the Australian naval defence force.

Key Provisions

The main operative sections of these Regulations under the Naval Defence Act 1910-1934 primarily concern amendments to the Naval Establishments Regulations. Regulation 1 amends the table of positions and pay rates within the existing regulations, introducing new positions and altering existing ones, as well as adjusting the remuneration for these roles. Regulation 2 introduces a variation in salary adjustments based on cost of living, specifically altering the timing of when these adjustments will be applied. The obligations and requirements imposed by these Regulations are primarily administrative and financial in nature. They require the updating of payroll systems to reflect the new positions, pay scales, and the revised timing for salary adjustments. The Regulations necessitate that any new employees hired into these roles be compensated according to the new rates, and that existing employees be re-evaluated and compensated appropriately if their roles have changed or if they are to be moved to a new position. Breaches of these Regulations, though not explicitly detailed within the text, could potentially lead to legal and financial repercussions. For instance, failure to adhere to the new pay scales or to implement the revised cost of living adjustments could result in disputes with employees, which might lead to legal action. Additionally, any financial mismanagement resulting from these changes, such as underpayment or overpayment, could result in financial penalties or legal consequences for those responsible within the administrative framework of the Navy.
