These Regulations may be cited as the Naval Establishments Regulations.

2 Repeal

The Naval Establishments Regulations (Statutory Rules 1926, No. 197, as amended to present date) are hereby repealed as from the commencement of these Regulations, save as to anything lawfully done or any right, privilege, obligation or liability acquired, accrued or incurred thereunder.

101 Powers etc of members of Naval Police

(1) For the purpose of ascertaining whether an offence is being or has been committed or attempted at any naval establishment, a member of the Naval Police may, without warrant, detain and search any person who is in a naval establishment, or any bag, parcel, vehicle, or other receptacle which is in, or is being conveyed into, or out of, a naval establishment, or any ship, boat or aircraft in or alongside or in the vicinity of a naval establishment.

(2) If a member of the Naval Police has reasonable ground to believe:

(a) that any person has committed, or attempted to commit, any offence in a naval establishment; and

(b) that proceedings against the person by summons would not be effective;

he may, without warrant, apprehend the person and deliver him into the custody of the civil authorities to be dealt with according to law.

(3) For the purposes of this regulation, offence means an offence against the common law, the Naval Defence Act 1910-1934, the Control of Naval Waters Act 1918, the Crimes Act 1914-1932 or any other Act relating to naval establishments or government property generally.
