Overview
The Naval Defence Act 1910-1952, enacted by the Commonwealth Parliament, aimed to provide for the defence of the Commonwealth and its territories by establishing and maintaining a naval force. The Act was instrumental in defining the structure, organisation, and operation of the Royal Australian Navy, ensuring that the nation's maritime defences were adequately provided for. In 1954, the Governor-General, in accordance with the advice of the Federal Executive Council, introduced Statutory Rules to amend the Naval Establishment Regulations under this Act. These amendments primarily addressed the rates of travelling allowances and allowances to officers working within defined distances, reflecting the policy objective of ensuring that naval personnel were fairly compensated for their duties and travel requirements.
Scope and Application
The Statutory Rules of 1954, No. 31, Regulations under the Naval Defence Act 1910-1952, amend the Naval Establishment Regulations to modify the rates of travelling allowances for officers and employees within the Naval Defence sector. These regulations apply to all officers and employees within the Commonwealth of Australia's naval defence services, including those in capital cities and other areas, with specific allowances adjusted based on salary brackets and marital status. The regulations cover both initial allowances for the first twenty-one days of residence at a new location and subsequent weekly allowances. The geographic scope of these regulations is national, applying uniformly across Australia, and they do not specify exclusions or exemptions beyond the defined categories. The application of these regulations can be further extended or modified through subordinate instruments, allowing for adjustments to allowances and other related provisions as necessary.
Key Provisions
The primary operative sections of these Regulations (sections 1 and 2) amend the Naval Establishment Regulations by updating the rates of travelling allowances and allowances to officers working within defined distances. Section 1 modifies the table in Regulation 75 by replacing it with new rates based on salary brackets and location, such as capital cities or other areas. This amendment specifies the daily and weekly allowances for officers and employees, both married and unmarried, depending on whether they have resided in their location for less than or more than twenty-one days. Section 2 similarly updates Regulation 76, adjusting the allowances for officers based on the duration of their continuous residence at a temporary station, distinguishing between periods of less than three weeks and three weeks or more.
The obligations imposed by these Regulations primarily concern the provision of accurate and updated allowances for officers and employees within the naval service. These Regulations mandate that the new rates outlined in the amended tables are to be applied accordingly. This includes ensuring that officers and employees receive the correct daily and weekly allowances based on their salary, marital status, and duration of residence at their assigned locations. The Regulations require adherence to these new rates, which reflect changes in economic conditions or other relevant factors impacting the cost of living and working in different areas.
Failure to comply with these Regulations can result in civil consequences for those responsible for administering the allowances. Specifically, officers and employees who do not receive the correct allowances as stipulated in the amended Regulations may have grounds to seek redress. While the Regulations do not explicitly outline penalties for non-compliance, breaches could potentially lead to legal action for the incorrect payment of allowances. Additionally, the responsible authorities could face scrutiny or investigation for not adhering to the updated rates, potentially impacting their administrative duties and responsibilities within the naval service.
