Overview
The Statutory Rules 1967 No. 146, enacted under the authority of the Naval Defence Act 1910-1966, address the need for updated salary rates for officers of the Professorial Staff at the Royal Australian Naval College. This legislative instrument was made by the Governor-General in and over the Commonwealth of Australia, acting on the advice of the Federal Executive Council. The policy objective appears to be to ensure that the compensation for these officers is equitable and reflects their professional status, thereby maintaining the quality and attractiveness of the Naval College as an educational institution. Transitional provisions are also included to provide additional salary to officers who served during a specified period, ensuring fairness and continuity in remuneration.
Scope and Application
The Naval Defence Act 1910-1966 encompasses regulations governing the Australian Naval Defence Force, with the 1967 Statutory Rules amending specific provisions under the Naval College Regulations. These regulations apply to officers of the Professorial Staff who are employed at the Royal Australian Naval College, including those who were in service during the transitional period from October 19, 1966, to July 5, 1967. The scope of these regulations involves the adjustment of salary rates and increments for various officer grades, including Director of Studies, Master-in-Charge, Senior Master, and Master. The regulations also include a transitional provision that ensures officers who served during the specified period receive additional compensation to align with the new salary rates. The amendments are geographically confined to the Commonwealth of Australia, specifically impacting personnel within the naval college and related entities under the Naval Defence Act. These regulations do not explicitly state any exclusions or exemptions, thereby applying broadly to all qualifying officers within the specified timeframe and roles. The application and enforcement of these regulations may be further extended or refined through subordinate instruments under the authority of the Naval Defence Act.
Key Provisions
The Statutory Rules 1967 No. 146, made under the Naval Defence Act 1910-1966, include amendments to the Naval College Regulations, specifically focusing on the rates of pay for officers of the Professorial Staff. Regulation 37 has been amended to revise the salary scales for various officer grades, including Director of Studies, Master-in-Charge, Senior Master, and Master. These amendments are effective from the sixth day of July, 1967. For instance, the Director of Studies now receives an annual salary of $7,180 with an annual increment of $320 upon classification, and a maximum salary of $7,820. Similarly, other grades have their respective salary scales updated.
The regulations impose specific obligations on the parties involved. For instance, the new salary scales must be adhered to for officers of the Professorial Staff serving on or after the specified date. Furthermore, officers who served during the transitional period from the nineteenth day of October, 1966, to the fifth day of July, 1967, are entitled to additional compensation if their previous salary was lower than what they would have earned under the new scales. This transitional payment ensures that officers who were employed during the interim period receive the appropriate compensation for their service.
There are no explicit provisions within the Statutory Rules 1967 No. 146 that outline offences, penalties, or consequences for breach. However, as these regulations are made under the Naval Defence Act 1910-1966, any non-compliance with the Act or its subordinate legislation could potentially result in legal consequences. In the context of the Naval Defence Act, breaches may lead to disciplinary action, financial penalties, or other administrative measures as deemed appropriate by the relevant authorities. The exact nature and extent of these consequences would be governed by the broader provisions of the Act and any applicable Defence Force Regulations.
