Overview

The Statutory Rules 1965 No. 68, titled "Regulations under the Naval Defence Act 1910-1964," were enacted in 1965 to amend the existing Naval College Regulations. These regulations were made under the authority of the Naval Defence Act 1910-1964, and were developed to address the need for updating certain provisions within the Naval College framework to better align with the contemporary operational and administrative needs of the Australian Defence Force. The regulations were enacted by the Administrator of the Government of the Commonwealth of Australia, Henry Abel Smith, with the advice of the Federal Executive Council, and were notified in the Commonwealth Gazette on 3 June, 1965. The policy objective of these amendments was to ensure that the remuneration and operational regulations for the Naval College staff, including officers of the Professorial Staff, were up-to-date and reflective of the current standards and requirements.

Scope and Application

The Statutory Rules 1965 No. 68, which are Regulations under the Naval Defence Act 1910-1964, apply to the officers and staff of the Royal Australian Naval College, specifically addressing the amendments to the Naval College Regulations. These regulations affect personnel directly employed at the Naval College, including officers of the Professorial Staff, Master-in-Charge, Senior Masters, and Masters, among others. The geographic reach of these regulations is limited to the Commonwealth of Australia, as they pertain to a federal institution. The Regulations include specific amendments to salary structures, increments, and leave entitlements for the specified categories of staff, as well as the repeal of certain regulations related to the Cadet Midshipmen’s Canteen, dental treatment, rates of pay, and other administrative provisions. No explicit exclusions or exemptions are stated within the text, but the application of these regulations is inherently confined to the Naval College and its staff. The Regulations also indicate that further modifications may be introduced through subordinate instruments, enabling future adjustments to the administrative and operational framework of the Naval College.

Key Provisions

The primary operative sections of the Statutory Rules 1965 No. 68, made under the Naval Defence Act 1910-1964, involve amendments and repeals to the Naval College Regulations. Specifically, Regulation 3 is amended to remove the Cadet Midshipmen's Canteen from Part VI (regulation 4), while Regulation 13 is repealed entirely (regulation 2). Additionally, Regulations 28, 29, and their heading are repealed (regulation 3). Regulation 37 is modified to replace the table detailing officer salaries with a new table (regulation 4(1)), and provisions concerning the annual rate of salary for Professorial Staff officers are detailed in regulations 4(2) to 4(4). Regulation 53 is amended by removing a clause related to Regulation 54 (regulation 5). Multiple regulations, including 54, 55, 56, 62, 66, 67, 68, 79, and 80, are repealed (regulation 6). Finally, Part VI is repealed entirely, and Regulation 85 is also repealed (regulations 7 and 8). These regulations impose several obligations and requirements on the entities governed by them. Firstly, they mandate the removal of the Cadet Midshipmen's Canteen from the existing regulatory framework, thus affecting how such facilities are managed or operated within the Naval College. Secondly, the repeal of certain regulations, such as Regulation 13, removes specific provisions that were previously in place, which could impact the operation or administration of the Naval College. The amendments to Regulation 37 introduce new salary scales for officers, affecting their remuneration and potentially their employment terms. The removal of references to Regulation 54 in Regulation 53 suggests a streamlining of procedures related to leave during vacation periods, affecting how leave is managed and approved. The repeal of multiple regulations, including 54, 55, 56, 62, 66, 67, 68, 79, and 80, indicates a significant restructuring of the governance framework of the Naval College, which would necessitate adjustments in compliance and operational protocols. In terms of consequences for non-compliance, the Statutory Rules 1965 No. 68 do not explicitly outline specific offences, penalties, or civil/criminal consequences for breach. However, failure to adhere to the amended and repealed regulations could potentially lead to administrative or procedural issues within the Naval College. Such non-compliance might result in internal disciplinary actions, depending on the specific nature and impact of the breach. It is important to note that while the rules themselves do not specify penalties, broader legislative frameworks and institutional policies may impose consequences for non-compliance with regulatory requirements.
