STATUTORY RULES.

1942. No. 427.

 

REGULATIONS UNDER THE NATIONAL SECURITY ACT 1939-1940.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the National Security Act 1939-1940.

Amendments of National Security (Wheat Industry Stabilization) Regulations.†

1. Regulation 2 of the National Security (Wheat Industry Stabilization) Regulations is amended by omitting from the definition of The Australian Wheat Board the words “Wheat Acquisition and inserting in their stead the words National Security (Wheat Acquisition).

2. Regulation 3 of the National Security (Wheat Industry Stabilization) Regulations is amended—

(a) by omitting from sub-regulation (1.) the word three and inserting in its stead the word four; and

(b) by adding at the end thereof the following sub-regulations:—

(3.) At any meeting of the Board, three members shall constitute a quorum.

(4.) At all meetings of the Board, the Chairman shall have a deliberative vote, and, in the case of an equality of votes, shall also have a casting vote..

3. After regulation 4 of the National Security (Wheat Industry Stabilization) Regulations the following regulation is inserted:—

State Committees.

4a.—(1.) For the purposes of these Regulations there shall be a Committee appointed for each State.

(2.) Each Committee shall consist of—

(a) one person representing the Commonwealth Government; and

(b) two persons representing wheat growers in that State,

who shall be appointed by the Minister by notice published in the Gazette and who shall hold office during the pleasure of the Minister.

(3.) A Committee shall have such powers and functions as these Regulations confer or as the Board thinks fit but shall exercise all its powers and functions subject to any directions of the Board.

(4.) The person appointed to represent the Commonwealth Government shall be the Chairman of a Committee.

(5.) In the absence of the Chairman of a Committee, the members present at any meeting may elect one of their number to preside at that meeting.

(6.) At any meeting of a Committee, two members shall form a quorum.

(7.) All questions before a Committee shall be decided by a majority of votes and, in the event of the voting being equal on any question, the question shall be postponed for consideration at the next meeting of the Committee at which all the members are present.

(8.) Any member of the Board shall have the right to attend and to take part in the proceedings of any meeting of a Committee:

Provided that the member of the Board shall not vote or be counted in any quorum..

Fees and expenses.

4. Regulation 5 of the National Security (Wheat Industry Stabilization) Regulations is amended by inserting, after the word member,, the words and to any member of a Committee appointed under the last preceding regulation,.
