Overview

The National Security (Vegetable Seeds) Regulations 1942 were enacted to ensure an adequate supply of vegetable seeds in Australia during wartime, safeguarding their purity and germination. This legislative instrument was made under the authority of the National Security Act 1939–1940 by the Governor-General in Council, with the Minister of State for Commerce administering it. The policy objective of these Regulations was to maintain the integrity and availability of vegetable seeds, critical for food security during the war. The establishment of the Vegetable Seeds Committee aimed to oversee these efforts, with representatives from the Commonwealth government, agricultural bodies, growers, and merchants. The Regulations provide mechanisms for registration of growers, control over the sale of seeds, and powers for the Committee to manage the production, storage, and distribution of vegetable seeds, as well as protection against enemy actions.

Scope and Application

The National Security (Vegetable Seeds) Regulations, made under the National Security Act 1939–1940, are designed to ensure an adequate supply of vegetable seeds in Australia during wartime and to maintain the trueness to type, purity, and germination of those seeds. These Regulations apply to the production, sale, and distribution of vegetable seeds, and are administered by the Minister of State for Commerce. The regulations establish a Vegetable Seeds Committee to oversee these activities, consisting of representatives from the Commonwealth Government, the Standing Committee on Agriculture, growers of vegetable seeds, and merchants of vegetable seeds. The Committee has extensive powers to manage the registration of growers, regulate the sale of seeds, require the destruction or disposal of vegetable crops, and mandate the safeguarding and dispersal of seeds to protect against enemy action. The Committee can also purchase, sell, process, store, and guarantee the quality of vegetable seeds, and can enter upon land or premises to enforce its directives. These Regulations extend throughout the Commonwealth of Australia, and the Committee has the authority to delegate its powers and functions to ensure effective oversight and implementation. Notably, the regulations provide mechanisms for the authentication of notices, directions, and requirements issued by the Committee and set out the conditions for the proper care and handling of vegetable seeds by individuals.

Key Provisions

The National Security (Vegetable Seeds) Regulations, made under the National Security Act 1939–1940, focus primarily on ensuring the adequate supply of vegetable seeds in Australia during wartime, as well as maintaining the trueness to type, purity, and germination of these seeds. The Regulations are administered by the Minister of State for Commerce (s2). The Regulations establish a Vegetable Seeds Committee, which consists of representatives from the Commonwealth Government, the Standing Committee on Agriculture, growers of vegetable seeds, and merchants of vegetable seeds (s5). This Committee is tasked with various functions including the registration of growers, prohibiting the sale of seeds by unregistered growers, and directing the destruction or disposal of vegetable crops (ss14-16). The Committee also has the authority to require the dispersal of seeds to protect against enemy action and to ensure the proper care and safeguarding of vegetable seeds (ss18, 23). The Regulations impose several obligations on the parties they govern. For instance, growers of vegetable seeds must apply for registration with the Committee before sowing their crops or, in special cases, during the growth of their crops (s14). Unregistered growers are prohibited from selling, exchanging, or disposing of their vegetable seeds for valuable consideration (s15). Registered growers must comply with any directions issued by the Committee regarding the sale or disposal of their seeds (s15). Additionally, any person with vegetable seeds in their possession must take proper care to safeguard those seeds from damage or deterioration and must comply with any directions from the Committee for the preservation of those seeds (s23). Failure to comply with the provisions of these Regulations can result in civil and criminal consequences. For example, an unregistered person who sells, exchanges, or disposes of vegetable seeds for valuable consideration may face prosecution under the National Security Act 1939–1940 (s24). While the specific penalties for breaches of these Regulations are not detailed within the Regulations themselves, breaches of the National Security Act 1939–1940 can result in substantial penalties, including fines and imprisonment, depending on the nature and severity of the breach.
