6. These Regulations shall be deemed to have come into operation on the twenty-ninth day of December, 1949.

Overview

The National Security (Staff of War-time Authorities) Regulations 1951 were enacted to address the need for streamlined and updated salary and employment conditions for staff within war-time authorities in Australia. These regulations were made under the Defence (Transitional Provisions) Act 1946–1950 and came into effect on 29 December 1949. The primary objective of these regulations was to align the salaries and employment conditions of officers within these authorities with those of the Commonwealth Public Service, ensuring consistency and fairness in remuneration and conditions of employment. This was achieved by specifying salary scales and incorporating relevant provisions from the Public Service Regulations and the Public Service Arbitration Act 1920–1950.

Scope and Application

The National Security (Staff of War-time Authorities) Regulations, as amended by the Statutory Rules 1951, No. 96, apply to officers who occupy specific offices as detailed in the Schedule of the Regulations. These Regulations are concerned with the salaries and conditions of employment for these officers, who are part of war-time authorities within the Commonwealth. The regulations outline the minimum and maximum salaries for various positions and include provisions for salary increments. The amended Regulations also incorporate conditions of employment from the Public Service Regulations or determinations made under the Public Service Arbitration Act 1920-1950, such as leave, attendance, duty performance, and overtime payment, among others. These Regulations came into operation on the twenty-ninth day of December 1949, and various sub-regulations and schedules have been repealed or replaced with new provisions. The Regulations extend throughout the Commonwealth of Australia and apply to officers in specified positions, with no stated exclusions or exemptions in the provided text. The application of the Regulations may be further defined through subordinate instruments as necessary.

Key Provisions

The National Security (Staff of War-time Authorities) Regulations, as amended by these Statutory Rules, primarily focus on the salaries of officers and their conditions of employment. Regulation 5 outlines the salary structure for officers, specifying minimum and maximum salaries based on their office, as detailed in the Schedule to these Regulations (Reg. 5(1)). Regulation 6, which has been amended, provides that officers are subject to the Public Service Regulations concerning leave, attendance, performance, duty hours, and other employment conditions (Reg. 7). The Regulations impose obligations on the officers to adhere to the specified salary structures and employment conditions. Officers are required to be paid according to the minimum salary specified in the Schedule, or a higher salary determined by the Board, not exceeding the maximum salary (Reg. 5(1)). Furthermore, officers must comply with the Public Service Regulations as they apply to their respective roles and responsibilities (Reg. 7). Breaches of these Regulations may lead to civil or administrative consequences, although the specific penalties are not outlined in the text. Non-compliance with the specified salary conditions or employment terms could result in disputes or claims under the Public Service Regulations or other applicable laws. The regulations do not explicitly mention criminal penalties but imply that violations may be subject to the general laws governing employment and public service standards.
