Overview

The Statutory Rules of 1947, No. 15, made under the Defence (Transitional Provisions) Act 1947, establish regulations for the amendment of the National Security (Shipping Coordination) Regulations. These regulations were enacted to streamline and clarify the transitional procedures following the Second World War, addressing the need for efficient shipping coordination in the post-war environment. The enacting body responsible for these regulations is the Governor-General in and over the Commonwealth of Australia, acting on the advice of the Federal Executive Council. The primary policy objective of these amendments is to replace references to the dissolved Stevedoring Industry Commission with the Board, ensuring the continued coordination of shipping activities under a new regulatory framework.

Scope and Application

The Defence (Transitional Provisions) Regulations 1947, made under the Defence (Transitional Provisions) Act 1947, pertain to amendments of the National Security (Shipping Co-ordination) Regulations. The regulations specifically affect the powers and functions associated with shipping authorities, with changes aimed at transitioning these responsibilities to a Board. This transitional approach involves the removal of references to the Stevedoring Industry Commission and shipping authorities, replacing them with references to the Board. The regulations are applicable to the Commonwealth, impacting the governance and administrative functions within the shipping sector as part of post-war reconstruction efforts. While the regulations focus on streamlining and reallocating certain powers, they do not explicitly state exclusions or exemptions, implying a broad application across the shipping industry under the newly defined Board’s purview.

Key Provisions

The primary operative sections of the Statutory Rules 1947, No. 15, made under the Defence (Transitional Provisions) Act 1947, pertain to the amendments of the National Security (Shipping Co-ordination) Regulations. Specifically, Part Regulation 4 is amended by removing the reference to Part V, which pertains to the Stevedoring Industry Commission (Regulation 2). Definitions previously associated with "Shipping authority" and "the Stevedoring Industry Commission" are omitted from Regulation 5 (Regulation 4). Regulation 6, 7, and 9 are amended by replacing instances of "any shipping authority" with "the Board," thereby shifting certain powers and functions from unspecified shipping authorities to the Board (Regulations 3, 4(a), 4(b), and 5). Regulation 12 is similarly amended to replace "any shipping authority" with "the Board" in sub-regulation (1) (Regulation 6). Finally, Regulation 49 is amended by changing "The Board shall" to "The Board may," thereby modifying the mandatory nature of certain Board functions to discretionary ones (Regulation 7). These regulations impose several obligations and requirements on the Board and its members. The Board, now empowered to perform certain functions previously assigned to unspecified shipping authorities, must ensure that shipping coordination activities are efficiently managed and aligned with national security objectives. Members of Parliament who are members of the Board must adhere to the duties and responsibilities outlined in the amended regulations, including those related to the appointment of officers and employees, which are now centralised under the Board’s purview (Regulation 6). The Board’s powers and functions, as amended, must be exercised in accordance with the statutory framework and any relevant policies or directives issued by the relevant authorities. Failure to comply with these regulations may result in civil or criminal consequences, although the specific penalties are not detailed within the statutory rules. Generally, breaches of regulations under the Defence (Transitional Provisions) Act 1947 could lead to fines or other penalties as prescribed by the relevant legislation. For instance, the National Security (Shipping Co-ordination) Regulations might stipulate specific penalties for non-compliance, which would be applicable in this context. It is advisable for entities governed by these regulations to consult the full text of the associated regulations to understand the full extent of potential penalties and legal ramifications.
