Overview

The Statutory Rules 1948 No. 1, enacted under the Defence (Transitional Provisions) Act 1946-1947, address the need to transition control and management of liquid fuel from the Commonwealth Liquid Fuel Control Board to the Controller of Liquid Fuel. This legislative instrument was made by the Governor-General in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council. The policy objective was to ensure a smooth and legally sound transition of responsibilities and authorities in the aftermath of World War II, facilitating the winding down of wartime controls and adapting them to peacetime needs. The Regulations amended the National Security (Liquid Fuel) Regulations to reflect this transition, ensuring that existing orders and documents remained valid and enforceable under the new framework.

Scope and Application

The Defence (Transitional Provisions) Act 1946-1947 provides the legislative framework for these Regulations, which focus on the amendments to the National Security (Liquid Fuel) Regulations concerning the abolition of the Commonwealth Liquid Fuel Control Board. These Regulations apply to all persons and entities previously regulated by the Commonwealth Liquid Fuel Control Board, including fuel suppliers, retailers, and consumers, as well as any documents or permits issued by the Board prior to the commencement of these Regulations. The Regulations have a national reach as they are issued under Commonwealth law. The Regulations do not specify exclusions or exemptions but effectively transfer the responsibilities of the abolished Board to the Controller of Liquid Fuel, ensuring continuity in the regulation of liquid fuel supply and distribution. The application and enforcement of these Regulations may be further detailed or adjusted through subordinate instruments or subsequent amendments.

Key Provisions

The primary sections of the Statutory Rules 1948 No. 00084, made under the Defence (Transitional Provisions) Act 1946-1947, involve amendments to the National Security (Liquid Fuel) Regulations. These amendments primarily address the abolition of the Commonwealth Liquid Fuel Control Board and the transition of its functions to the Controller of Liquid Fuel. For instance, Regulation 1 stipulates that any orders, directions, authorities, permits, licenses, or other documents made by the Commonwealth Liquid Fuel Control Board before the commencement of these Regulations and in force at the commencement of these Regulations will continue to be valid, as if made by the Controller of Liquid Fuel (Regulation 1(2)). Any references to the Commonwealth Liquid Fuel Control Board in these documents will be read as references to the Controller of Liquid Fuel (Regulation 1(3)). Additionally, Regulation 2 repeals Regulation 17 of the National Security (Liquid Fuel) Regulations, which pertained to the requirement of licenses or ration tickets in certain cases. These Regulations impose specific obligations on parties governed by them. For example, they mandate that all existing orders, directions, authorities, permits, licenses, or other documents made by the Commonwealth Liquid Fuel Control Board remain effective, with references to the Board being read as references to the Controller of Liquid Fuel (Regulation 1). Furthermore, the Regulations require that any new bulk supplier’s licenses issued must reflect an amendment in Regulation 30, changing the numerical figure from "28" to "29". Moreover, Regulation 4 removes the fee requirement for issuing duplicate licenses, thus making the process free of charge. In terms of breaches and penalties, the Regulations themselves do not explicitly state penalties for non-compliance. However, any failure to adhere to the transitional provisions as outlined could potentially lead to legal repercussions under the broader Defence (Transitional Provisions) Act 1946-1947 or other relevant statutes. Non-compliance with the provisions concerning the continued validity of documents or the amendment of licenses might result in actions taken under the authority of the relevant Minister or other governing bodies, including potential administrative or legal penalties.
