Overview

The Regulations under the National Security Act 1939-1940, enacted in 1943, address the urgent need to regulate the engineering trades to meet the exceptional circumstances arising from World War II. These regulations were made by the Deputy of the Governor-General, acting on advice from the Federal Executive Council, on behalf of the Minister of State for Defence. The primary policy objective of these regulations is to give effect to agreements made with unions and employers to facilitate the employment of women and other qualified personnel in engineering trades, while ensuring that qualified tradesmen are prioritised for employment. The regulations aim to supplement the existing agreements by setting out detailed administrative provisions, including the application of regulations to females, the establishment of Local Dilution Committees, and the regulation of wages and employment conditions for added tradesmen and females in the engineering sector.

Scope and Application

The Regulations under the National Security Act 1939-1940 pertain to the engineering trades dilution and apply to both males and females in the engineering trades, affecting the employment of recognised tradesmen, added tradesmen, and females. These regulations have a Commonwealth reach and aim to implement agreements made with the Amalgamated Engineering Union, the Australasian Society of Engineers, and certain employers to address the exceptional circumstances arising out of the present war. The regulations supplement the aforementioned agreements and govern the employment of women in the engineering trades. Employers in the engineering industry are required to provide particulars of their employees to Local Dilution Committees and comply with the provisions governing the employment of added tradesmen and females. The regulations are administered by the Central Dilution Committee and Local Dilution Committees, which have the authority to permit dilution, regulate employment, and make determinations on the competence of tradesmen. The Secretary of the Department may authorise officers or employees of the Commonwealth to conduct investigations and inspections within the scope of these regulations.

Key Provisions

The primary operative sections of the National Security (Engineering Trades Dilution) Regulations (C1943L00143) focus on regulating the employment of women in engineering trades, updating definitions, and modifying the application of certain regulations. Section 3 revises the objects of the regulations, specifically to address the employment of women in engineering trades and to supplement agreements made with trade unions and employers during the war. Section 4 amends the definition of a “recognized tradesman” to include “second-class machinist.” Section 5a extends the applicability of these regulations to females, ensuring that the rules governing males also apply to females in these engineering trades. These regulations impose several obligations on employers and Local Dilution Committees. Employers must furnish Local Dilution Committees with detailed information about individuals performing work ordinarily done by second-class machinists (Section 17a). They must also ensure that recognized tradesmen are employed before adding any tradesmen, and they must not dismiss recognized tradesmen or male added tradesmen without the committee's consent when reducing staff (Section 18). Added tradesmen, both male and female, must agree to abandon their positions when competent recognized tradesmen become available (Section 18(5) and (6)). Breaches of these regulations may result in various consequences. Section 22 grants officers or employees of the Commonwealth the authority to investigate and report on compliance with these regulations. They can enter and inspect any establishment during working hours and interview employees. Importantly, Section 22(3) explicitly states that individuals must not hinder or obstruct these authorized officers or employees. While the specific penalties for breaches are not detailed in the regulations, such obstruction could lead to legal consequences under the broader National Security Act 1939-1940 or other relevant laws. Non-compliance with the obligations outlined in these regulations, such as failing to provide necessary information to Local Dilution Committees or dismissing employees without consent, could similarly result in legal actions or penalties as deemed appropriate under the overarching legislative framework.
