Overview

The Statutory Rules 1941 No. 316, Regulations Under the National Security Act 1939–1940, were enacted by the Governor-General in Council to make amendments to the National Security (Apple and Pear Acquisition) Regulations. These regulations were introduced to address the need for streamlined and efficient governance structures within the Australian Apple and Pear Marketing Board during a period of national security. The policy objective was to ensure that the board could operate effectively and make timely decisions by modifying its composition and the roles of its members. The regulations were passed by the Federal Executive Council and aim to provide a more agile and responsive framework for the board’s operations by adjusting the board's membership and the functions of its Advisory Council and State Committees.

Scope and Application

These regulations, made under the National Security Act 1939–1940, pertain specifically to the apple and pear industry in Australia, establishing frameworks and structures to manage the acquisition and marketing of these commodities within a national security context. They apply to the Australian Apple and Pear Marketing Board, which is responsible for overseeing the industry under these regulations. The Board is composed of a diverse membership, including representatives from various states and an Executive Member, and is supported by an Advisory Council consisting of state committee chairmen or their deputies. The regulations define the roles, functions, and operational procedures for these entities, including the composition and meeting protocols of the Advisory Council, and the roles of State Committees within the Board. These regulations extend across the Commonwealth of Australia, applying uniformly to all states and territories. The changes made through these regulations primarily focus on restructuring the Board and Advisory Council to streamline decision-making processes and clarify roles, without introducing any exclusions, exemptions, or thresholds. The regulations also address indemnity and remuneration for members of the Board and the Advisory Council. The application and interpretation of these regulations may be further defined through subordinate instruments as needed.

Key Provisions

The National Security (Apple and Pear Acquisition) Regulations have undergone several amendments aimed at restructuring the governance and operational framework of the Australian Apple and Pear Marketing Board. Firstly, Regulation 4 has been revised to replace the six members representing each of the six States with a single Executive Member, thereby streamlining the composition of the Board (1). Additionally, sub-regulation (3.) has been omitted from Regulation 4, eliminating any previous specific provisions that might have been in place. Furthermore, Regulation 5b has been amended to remove sub-regulations (2.), (3.), and (4.), which likely pertained to the previous meeting procedures and quorum requirements (2). To replace these provisions, Regulation 5c has been inserted, establishing an Advisory Council composed of six members, including the Chairman of each State Committee or their appointed deputies (3). This Advisory Council is tasked with advising the Board on matters submitted to it and making recommendations on other regulatory issues. The Advisory Council's operations are detailed in the newly inserted Regulation 5c, which stipulates that meetings shall be held as determined by the Board or directed by the Minister (3). A majority of the Council's members constitutes a quorum, and each meeting elects a Chairman from among the members present. Decisions within the Council are made by majority vote, with the Chairman having only a deliberative vote. Importantly, Board members have the right to attend Advisory Council meetings without voting or affecting the quorum (3). In addition to these changes, Regulation 6 has been amended to require each State Committee to appoint a Chairman and a Deputy Chairman from among its members (4). Moreover, Regulation 6a has been revised by removing a proviso from sub-regulation (1.), potentially altering the procedures or criteria for appointing deputies. The indemnity provisions in Regulation 6b have been expanded to include the Advisory Council, ensuring that members of both the Board and the Advisory Council are protected from certain liabilities (6). Similarly, the remuneration provisions in Regulation 6c now apply to members of the Advisory Council, ensuring that they are compensated for their services (7). These amendments impose several obligations on the parties involved. The Australian Apple and Pear Marketing Board must now manage its operations with a streamlined structure, including the new Advisory Council, and ensure that the Council's functions align with the Board's objectives. State Committees are required to appoint Chairmen and Deputy Chairmen, and ensure that their members participate in Advisory Council meetings when necessary. Members of the Advisory Council, like those of the Board, must adhere to the new meeting and decision-making protocols, and Board members must respect the Advisory Council's autonomy while maintaining their advisory role. Failure to comply with these regulations may result in various consequences. While the specific offences and penalties are not detailed in the provided text, breaches of such regulations typically attract penalties under the National Security Act 1939–1940. These can include fines, imprisonment, or other civil and criminal sanctions as prescribed by the Act. The exact penalties would depend on the nature and severity of the breach, but they could range from substantial fines to significant periods of imprisonment, reflecting the serious nature of national security matters.
