Overview

The Statutory Rules of 1943, No. 46, are Regulations made under the National Security Act 1939-1940, aimed at addressing issues related to the acquisition of apples and pears for national security purposes during World War II. Enacted by the Governor-General with the advice of the Federal Executive Council, these Regulations sought to streamline and enhance the administrative framework for the acquisition process. The policy objective was to ensure efficient management and control of apple and pear supplies, critical for both domestic consumption and potential war efforts. These Regulations were designed to empower the Minister of State for Commerce and Agriculture, facilitating better oversight and execution of the acquisition process through the establishment of State Committees and Advisory Committees, among other measures.

Scope and Application

The Statutory Rules of 1943, No. 46, made under the National Security Act 1939-1940, introduce amendments to the National Security (Apple and Pear Acquisition) Regulations. These regulations apply to the acquisition and management of apples and pears for national security purposes, specifically focusing on the administration of these commodities to ensure they are available for essential needs during the Second World War. The Minister of State for Commerce and Agriculture is designated as the administrator of these regulations, with the authority to constitute State Committees for each state within the Commonwealth. These State Committees are composed of members appointed by the Minister and are tasked with exercising the powers and functions conferred by these regulations, subject to any directions from the Board. The regulations also allow the Minister to exempt certain states and territories from specific provisions through orders published in the Commonwealth Gazette. Additionally, the regulations establish Advisory Committees to provide advice on matters referred by the Board, ensuring a collaborative approach to managing apple and pear acquisitions. Furthermore, the Board is empowered to accept compensation claims outside the prescribed forms and has the authority to enter, search for, and inspect stocks and documents related to apples and pears, reinforcing the stringent control measures in place during this period.

Key Provisions

The operative sections of the legislation, Statutory Rules 1943 No. 46, amend the National Security (Apple and Pear Acquisition) Regulations by inserting new definitions, establishing State Committees, modifying the indemnity provisions, and introducing provisions for Advisory Committees. Regulation 1a (1) specifies that these Regulations will be administered by the Minister of State for Commerce and Agriculture. Regulation 6 (1) empowers the Minister to establish a State Committee for each state, which will consist of a number of members appointed by the Minister and holding office at the Minister’s pleasure. Regulation 6b (1) provides that members of the Board or a State Committee will not be liable for any act of the Board or Committee or of a member acting as such. Regulation 6ba (1) allows the Board to constitute Advisory Committees consisting of a number of members appointed by the Board and holding office during the Board's pleasure. Regulation 11a (1) allows the Minister to exempt certain states and territories from the application of regulations 9, 10, and 11 through a Gazette notice. The obligations imposed by the Act on the relevant parties include the establishment and administration of State Committees by the Minister, the provision of indemnity for Board and State Committee members, and the constitution of Advisory Committees by the Board. The Minister must appoint members to the State Committees and determine their number, and the Board must appoint members to Advisory Committees and determine their number. The Minister has the authority to exempt certain states and territories from specific regulations through a Gazette notice. Additionally, the Board and State Committees are required to accept claims for compensation under certain conditions, and the Advisory Committees must provide advice to the Board on referred matters. The legislation imposes various consequences for breaches, though specific offences and penalties are not detailed within the text provided. Generally, under the National Security Act 1939-1940, breaches of regulations could lead to criminal or civil penalties, depending on the nature and severity of the breach. For example, refusing or failing to comply with a requirement to furnish information or produce documents can lead to significant repercussions. Additionally, any person found to have destroyed, mutilated, defaced, secreted, or removed any book, document, or other paper with intent to evade the provisions of the Regulations may face legal action. The specific penalties for such offences would be determined by the courts based on the circumstances of each case.
