Overview
The National Residue Survey Levy Regulations 1993, as amended, were made under the National Residue Survey Administration Act 1992 and the National Residue Survey (Aquatic Animal Export) Levy Act 1992. These regulations were introduced to establish the framework for imposing a levy on specified products and activities, such as the milk fat content of relevant dairy produce, potatoes, citrus fruits, table grapes, stone fruits, and dried fruits, to fund the national residue survey for the detection and prevention of harmful residues in food and aquatic animals. The levy rate is currently set at $0.00 as per the regulations, and the regulations were first commenced on 1 July 1993. Over the years, they have been amended to reflect changes in the legislative environment and the needs of the national residue survey. The enactment of these regulations by the relevant legislature aimed to ensure adequate funding for the surveillance and monitoring of residues in food products to protect public health and maintain Australia's reputation in the global market.
Scope and Application
The National Residue Survey Levy Regulations, consolidated as in force on 5 October 1998, are legislative instruments made under the National Residue Survey Administration Act 1992 and the National Residue Survey (Aquatic Animal Export) Levy Act 1992. These regulations apply to the imposition of a levy on specific products and activities related to the national residue survey, and they are designed to ensure compliance with the standards set forth by the Acts. The levy is applicable to various products, including the milk fat content of relevant dairy produce, potatoes, citrus fruits, table grapes, stone fruits, and dried fruits, as specified in the regulations. Notably, the regulations detail that the rate of the National Residue Survey levy for these products and activities is $0.00, indicating a temporary or specific condition under which the levy is not applicable. The regulations came into effect on 1 July 1993 and have been subject to amendments over the years, as evidenced by the statutory rules and amendments table, reflecting updates and changes to the regulatory framework. The scope and application of these regulations are intended to cover the entire Commonwealth of Australia, ensuring a consistent approach to the levy across all states and territories.
Key Provisions
The National Residue Survey Levy Regulations (SR 1993 No. 82 as amended) establish the levy rate and specify the products and activities subject to this levy under the National Residue Survey Administration Act 1992 and the National Residue Survey (Aquatic Animal Export) Levy Act 1992. Section 1 identifies these regulations as the National Residue Survey Levy Regulations, while Section 2 sets their commencement date as 1 July 1993. Section 3 details the levy rate, which is currently $0.00 for the specified products and activities listed in subregulation (2). These include the milk fat content of relevant dairy produce, potatoes, citrus fruits, table grapes, stone fruits, and dried fruits.
The regulations impose specific obligations on entities involved in the specified products and activities, requiring them to adhere to the prescribed levy rates and comply with the administrative requirements outlined in the National Residue Survey Administration Act 1992. Entities must ensure that they accurately report and remit the applicable levy for their products or activities as stipulated by the regulations. Failure to comply with these obligations may result in legal repercussions.
The Act does not explicitly state any specific offences, penalties, or consequences for breaches of the National Residue Survey Levy Regulations. However, breaches of the National Residue Survey Administration Act 1992 or the National Residue Survey (Aquatic Animal Export) Levy Act 1992, which govern the implementation of these regulations, may incur civil or criminal penalties. These penalties could include fines or imprisonment, depending on the severity of the breach and the relevant state or territory laws. It is essential for entities to adhere to the regulations to avoid any potential legal consequences.
