Part 1—Preliminary

 

1  Name

  This instrument is the National Rental Affordability Scheme (Treasury) Delegations 2025.

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

  This instrument is made under the National Rental Affordability Scheme Act 2008.

4  Definitions

Note: Expressions have the same meaning in this instrument as in the National Rental Affordability Scheme Act 2008 as in force from time to time—see paragraph 13(1)(b) of the Legislation Act 2003.

  In this instrument:

the Act means the National Rental Affordability Scheme Act 2008.

the Regulations means the National Rental Affordability Scheme Regulations 2020.

Treasury means the Department of the Treasury.

Part 2—Delegations

5  General delegations to SES employees

 (1) Under subsections 11(1) and (2) of the Act, each person holding, occupying or performing the duties of each of the following offices or positions in the Treasury, is delegated all of the Secretary’s functions and powers under the Act and the Regulations (other than section 11 of the Act or subsection 41(8) of the Regulations):

 (a) a Deputy Secretary;

 (b) an SES employee.

Note: Section 11 of the Act is about delegations of the Secretary’s powers, and subsection 41(8) of the Regulations authorises the Secretary, by legislative instrument, to change the household income limits from time to time.
