Overview

The National Redress Scheme for Institutional Child Sexual Abuse Amendment (2023 Measures No. 7) Declaration 2023 was enacted to amend the National Redress Scheme for Institutional Child Sexual Abuse Act 2018, aiming to address the growing number of institutions implicated in child sexual abuse cases. This amendment was introduced by Amanda Rishworth, the Minister for Social Services, to expand the list of institutions covered by the Scheme, thereby ensuring that more victims can access redress and support. The enacting body for this instrument is the Parliament of Australia, reflecting the legislative intent to provide comprehensive support to survivors of institutional child sexual abuse. This declaration seeks to update and broaden the coverage of the National Redress Scheme by including additional institutions where abuse may have occurred. The amendments specify changes to the list of institutions and the types of organisations covered, ensuring that the Scheme remains responsive to the evolving nature of reported abuse cases. This legislative action is part of a broader policy objective to support and empower survivors, recognising the significant impact of institutional child sexual abuse and the need for a robust redress mechanism.

Scope and Application

The National Redress Scheme for Institutional Child Sexual Abuse Amendment (2023 Measures No. 7) Declaration 2023 applies to the institutions and entities involved in the National Redress Scheme for Institutional Child Sexual Abuse, providing a framework for the redress of survivors of institutional child sexual abuse. This Act amends the National Redress Scheme for Institutional Child Sexual Abuse Declaration 2018, updating the list of institutions covered by the scheme and clarifying certain provisions. The amendment extends the application of the scheme to include additional institutions and modifies the references to various institutions within the scheme. The Act applies across the Commonwealth of Australia, with the specified amendments taking effect immediately after the registration of the instrument. Notably, the Act does not introduce any exclusions, exemptions, or thresholds beyond those already established in the primary legislation. The application and operation of the scheme may be further refined or expanded through subordinate instruments, as authorised by the primary Act.

Key Provisions

The National Redress Scheme for Institutional Child Sexual Abuse Amendment (2023 Measures No. 7) Declaration 2023 amends the National Redress Scheme for Institutional Child Sexual Abuse Declaration 2018. Section 1 specifies the name of the instrument as the National Redress Scheme for Institutional Child Sexual Abuse Amendment (2023 Measures No. 7) Declaration 2023. Section 2 outlines the commencement of the provisions, with sections 1 to 4 and items in Schedule 1 commencing the day after the instrument is registered, while other items in Schedule 1 commence immediately after the provisions covered by table item 1. Section 3 confirms the authority under which the instrument is made, citing the National Redress Scheme for Institutional Child Sexual Abuse Act 2018. Section 4 states that each instrument specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned. The amendments made by this instrument primarily revise the list of institutions covered by the Scheme to include additional institutions and make technical corrections. For example, Section 11 (table item 5, column 1) modifies the list of institutions by omitting and inserting specific paragraphs. Subsection 15(1) (table item 8, column 1) and other similar sections make similar adjustments by omitting and inserting specific paragraphs or adding new items. The amendments also include adding new institutions such as the Christian Aboriginal Parent-directed School Incorporated, Church of the Foursquare Gospel in Australia, Staverton Kindergarten Association Inc, and Hockey Australia Limited. The obligations imposed by the Act on the parties and entities it governs include ensuring compliance with the updated list of institutions covered by the Scheme. Institutions must ensure they are aware of their inclusion or exclusion from the list and must adhere to any reporting or redress obligations that may arise under the Scheme. The updated list helps to ensure that the Scheme can effectively provide redress to victims of institutional child sexual abuse by covering as many relevant institutions as possible. There are no explicit offences, penalties, or civil/criminal consequences for breach mentioned in the text of the instrument. However, it is implied that failure to comply with the updated list of institutions and the obligations under the Scheme could lead to legal consequences, particularly if such non-compliance results in victims being denied redress or if institutions are found to have failed in their duty of care. The penalties and consequences would likely be determined by the broader legal framework under which the National Redress Scheme operates, including any relevant state or federal laws governing child protection and institutional obligations.
