Overview

The National Redress Scheme for Institutional Child Sexual Abuse Amendment (2023 Measures No. 5) Declaration 2023 was enacted to amend the National Redress Scheme for Institutional Child Sexual Abuse Act 2018. The enactment was overseen by Amanda Rishworth, Minister for Social Services, and it was made under the authority of the Act to address specific gaps in the coverage of institutions within the scheme. The instrument aims to ensure that the Scheme provides redress to victims of institutional child sexual abuse by extending the list of institutions covered under the scheme to include additional entities that were previously omitted or inadequately represented. The changes are designed to rectify oversights and provide broader coverage to affected individuals, thereby fulfilling the policy objective of offering comprehensive support and redress to victims of institutional child sexual abuse.

Scope and Application

The National Redress Scheme for Institutional Child Sexual Abuse Amendment (2023 Measures No. 5) Declaration 2023I, made by Amanda Rishworth, the Minister for Social Services, amends the National Redress Scheme for Institutional Child Sexual Abuse Declaration 2018. This instrument is enacted under the National Redress Scheme for Institutional Child Sexual Abuse Act 2018 and comes into effect on specific dates as outlined in the commencement table. The amendments involve adding and modifying entries in the schedule of institutions, including the addition of several new incorporated institutions and adjustments to existing entries. These changes are designed to ensure the scheme comprehensively addresses the redress for victims of institutional child sexual abuse across various institutions, thereby extending the scope and reach of the National Redress Scheme.

Key Provisions

The main operative sections of the National Redress Scheme for Institutional Child Sexual Abuse Amendment (2023 Measures No. 5) Declaration 2023I (sections 1 to 4) commence on the day after the instrument is registered (section 2(1)). Additionally, specific provisions in Schedule 1, items 1 and 5, will take effect immediately after the commencement of the aforementioned sections (section 2). The instrument amends the National Redress Scheme for Institutional Child Sexual Abuse Declaration 2018 by adding several institutions to the list of those covered by the Scheme. These include King’s Baptist Grammar School Incorporated, Swan Canoe Club Incorporated, Weeroona Bay Football and Sports Club Incorporated, Gymnastics Australia Limited, Belnorth Football Club Inc, Southern Highlands Christian School Ltd, Taldumande Youth Services Incorporated, Zig Zag Young Women’s Resource Centre Inc., Little Athletics Australia Limited, and Community Support & Outreach Services Central Coast Ltd. The amendments also modify the referencing of institutions within subsection 15(1) to include broader categories and additional institutions. The obligations imposed by the Act include the requirement for institutions listed under the Scheme to participate in the National Redress Scheme. This participation entails acknowledging past abuses, providing support to survivors, and facilitating the redress process. The amendments also involve adjustments in how institutions are referenced within the Scheme’s documentation, ensuring clarity and comprehensiveness in the coverage of implicated entities. Additionally, the Act mandates the Minister for Social Services to oversee the implementation of these amendments, ensuring they are integrated into the existing framework of the National Redress Scheme. Breach of the provisions under this Act may result in various civil or criminal consequences. While the specific penalties are not detailed within the provided text, breaches of similar legislation typically attract penalties ranging from fines to more severe sanctions, depending on the nature and severity of the breach. The enforcement of these penalties is overseen by relevant authorities, who ensure compliance with the Scheme’s objectives and the rights of survivors. The penalties are designed to deter non-compliance and to encourage institutions to fully participate in the redress process.
