Overview

The National Redress Scheme for Institutional Child Sexual Abuse Amendment (2023 Measures No. 2) Declaration 2023 was enacted to address certain gaps and issues identified in the administration of the National Redress Scheme for Institutional Child Sexual Abuse. This instrument amends the National Redress Scheme for Institutional Child Sexual Abuse Declaration 2018 and is made under the National Redress Scheme for Institutional Child Sexual Abuse Act 2018 by Amanda Rishworth, Minister for Social Services. The amendments aim to refine the list of institutions covered under the scheme, ensuring clarity and comprehensiveness in the redress process. The changes include modifications to specific sections and schedules, such as the addition and removal of certain institutions and their associated paragraphs, to accurately reflect the scope of institutions subject to the scheme. The Declaration outlines specific commencement dates for various provisions, with some elements coming into effect immediately after the instrument's registration and others following subsequent specified dates. The amendments aim to ensure that the scheme effectively addresses institutional child sexual abuse by providing a clear and updated framework for institutions involved. This legislative update is essential for maintaining the integrity and efficacy of the National Redress Scheme, ensuring that victims of institutional child sexual abuse have access to appropriate redress mechanisms.

Scope and Application

The National Redress Scheme for Institutional Child Sexual Abuse Amendment (2023 Measures No. 2) Declaration 2023 amends the National Redress Scheme for Institutional Child Sexual Abuse Act 2018. This instrument, made by Amanda Rishworth, Minister for Social Services, updates the list of institutions covered by the scheme to include additional entities that have been identified as having been involved in institutional child sexual abuse. The changes take effect on specified dates following the registration of the instrument. The amended list now encompasses institutions such as the CRC Churches institution, the ACS Mutual – C3 Churches institution, the TRY Australia institutions, and Gymnastics Victoria Incorporated, among others. This legislation applies to the Commonwealth of Australia and affects entities that were involved in institutional child sexual abuse, ensuring that victims of such abuse have access to redress through the National Redress Scheme. The application of this Act is extended through subordinate instruments, which may include regulations or other legislative instruments that further define or expand upon the provisions of the primary Act.

Key Provisions

The National Redress Scheme for Institutional Child Sexual Abuse Amendment (2023 Measures No. 2) Declaration 2023I is made under the authority of the National Redress Scheme for Institutional Child Sexual Abuse Act 2018. The Declaration amends the 2018 Declaration, which established the National Redress Scheme for Institutional Child Sexual Abuse. The operative sections of this amendment include updates to the list of institutions covered by the Scheme, modifications to the definitions of specific institutions, and adjustments to the table that governs the allocation of funds to victims (Schedule 1, items 2, 8, 11, 16, 3, and the remainder of Schedule 1). This legislative amendment imposes specific obligations on the National Redress Scheme, including the requirement to update the list of institutions that fall under the Scheme's purview to ensure comprehensive coverage of institutions involved in child sexual abuse. Additionally, the amendment modifies the definitions of certain institutions within the Scheme to reflect current organisational structures and names accurately. These changes are intended to ensure that the Scheme remains effective and relevant in addressing the needs of victims of institutional child sexual abuse. Failure to comply with the provisions of the National Redress Scheme for Institutional Child Sexual Abuse Act 2018 may result in legal consequences. While the specific penalties for non-compliance are not detailed in this text, generally, breaches of the Act could lead to civil or criminal penalties. Civil penalties might include fines or other monetary penalties, while criminal penalties could involve imprisonment, depending on the severity and nature of the breach. The exact penalties would be determined by the courts based on the specific circumstances of each case.
