Overview

The National Redress Scheme for Institutional Child Sexual Abuse Amendment (2023 Measures No. 1) Declaration 2023I was enacted by Amanda Rishworth, the Minister for Social Services, on 6 March 2023. This amendment was introduced to address the need for updates and refinements to the National Redress Scheme for Institutional Child Sexual Abuse, as established under the National Redress Scheme for Institutional Child Sexual Abuse Act 2018. The objective of this amendment is to ensure the Scheme remains effective in providing redress to victims of institutional child sexual abuse. The enacting body is the Australian Parliament, and the instrument amends the original Declaration 2018 to include updated references to institutions involved in child sexual abuse, reflecting new information and ensuring comprehensive coverage. The amendments in this instrument primarily focus on updating the list of institutions and clarifying references within the original Declaration, ensuring that the Scheme continues to offer support to victims by addressing any gaps or oversights in the initial implementation. This amendment ensures the Scheme remains a robust and responsive mechanism for redress, accommodating new information as it becomes available.

Scope and Application

The National Redress Scheme for Institutional Child Sexual Abuse Amendment (2023 Measures No. 1) Declaration 2023, made under the National Redress Scheme for Institutional Child Sexual Abuse Act 2018, amends the National Redress Scheme for Institutional Child Sexual Abuse Declaration 2018. The amendment applies to the specified institutions and entities listed in the Schedule, which include various Christian and Missionary Alliance churches, institutions, and other related entities across Australia. The amendment is designed to clarify and expand the list of institutions covered by the scheme, ensuring that more victims of institutional child sexual abuse are eligible for redress. The amendments are effective from the day after the instrument is registered, with certain provisions taking effect immediately after the commencement of the main provisions. The amendment does not specify any exclusions or exemptions, and the application is confined to the institutions listed within the Australian jurisdiction. The scope of the Act can be further extended or restricted through subordinate instruments as deemed necessary by the relevant authorities.

Key Provisions

The National Redress Scheme for Institutional Child Sexual Abuse Amendment (2023 Measures No. 1) Declaration 2023I (the "Declaration") amends the National Redress Scheme for Institutional Child Sexual Abuse Declaration 2018. The Declaration includes specific amendments to the list of institutions covered under the scheme, as detailed in Schedule 1. For example, it amends the list of Christian and Missionary Alliance of Australia institutions by adding additional paragraphs to Item 331 in the Table in Schedule 1. It also adds new institutions, such as The St Kilda Saints Football Club Ltd and The St Patricks College Townsville Limited institutions, to the list in Schedule 1 (Items 647 and 521, respectively). The Declaration imposes obligations on the institutions listed in the amended Schedule 1 to participate in the National Redress Scheme. This means that these institutions must comply with the requirements of the scheme, which includes providing redress to victims of institutional child sexual abuse. The institutions are also required to cooperate with the scheme administrators and provide relevant information and documentation to support their applications for redress. Failure to comply with the requirements of the National Redress Scheme for Institutional Child Sexual Abuse Act 2018, including the amendments made by the Declaration, may result in civil or criminal consequences. For example, an institution that fails to provide information or documentation as required by the scheme may be subject to enforcement action by the scheme administrators. Additionally, individuals who intentionally or recklessly provide false or misleading information to the scheme may be guilty of an offence under the Act and face penalties of up to $21,000 or imprisonment for up to two years, or both. The precise penalties for any offence under the Act are determined by the courts and may vary depending on the circumstances of the case. In summary, the Declaration amends the list of institutions covered under the National Redress Scheme for Institutional Child Sexual Abuse, imposing obligations on these institutions to participate in the scheme and provide redress to victims of institutional child sexual abuse. Failure to comply with the scheme requirements may result in civil or criminal consequences, including fines and imprisonment.
