Overview

The National Redress Scheme for Institutional Child Sexual Abuse Amendment (2022 Measures No. 6) Declaration 2022 was enacted to amend the National Redress Scheme for Institutional Child Sexual Abuse Act 2018. The instrument was introduced to address gaps in the coverage of institutions involved in child sexual abuse within the scheme. The enacting body is the Parliament of Australia, with Amanda Rishworth, the Minister for Social Services, making the declaration on 28 November 2022. The policy objective of the amendments is to expand the list of institutions covered by the scheme to ensure redress is available to victims of child sexual abuse from a broader range of organisations. The declaration includes updates to the list of institutions and adjustments to the table within the Act to ensure that the scheme can effectively reach and support those who have suffered from institutional abuse.

Scope and Application

The National Redress Scheme for Institutional Child Sexual Abuse Amendment (2022 Measures No. 6) Declaration 2022 applies to the amendments specified within its Schedules to the National Redress Scheme for Institutional Child Sexual Abuse Declaration 2018. This amendment process involves modifying and updating the list of institutions covered by the original legislation, ensuring that the redress scheme continues to offer support and recognition to victims of institutional child sexual abuse across various entities and organisations. The amendments reflect changes in the entities involved, ensuring the scheme's scope remains relevant and comprehensive. The legislation applies nationally, as it is enacted under the Commonwealth's authority through the National Redress Scheme for Institutional Child Sexual Abuse Act 2018. The amendments detailed in the Schedules adjust the list of institutions subject to the scheme, adding new entities while removing others, thereby refining the focus and coverage of the redress arrangements. The amendments extend the application of the Act by incorporating new institutions into the scheme, thus broadening its reach and ensuring that additional victims have access to the redress mechanisms provided.

Key Provisions

The National Redress Scheme for Institutional Child Sexual Abuse Amendment (2022 Measures No. 6) Declaration 2022 primarily involves amendments to the National Redress Scheme for Institutional Child Sexual Abuse Declaration 2018, as set out in Schedule 1. The amendments include modifications to the list of institutions covered by the scheme, such as adding certain councils and organisations, and omitting others (Schedule 1, items 1–9, 15–26). These changes were designed to refine the scope of institutions that fall under the scheme’s purview, ensuring that redress is available to victims of sexual abuse from a comprehensive range of institutions. Entities and parties governed by this Act are required to comply with the updated list of institutions specified in the amendments. These entities must ensure that they are accurately identified as either included or excluded from the scheme’s coverage. For example, institutions such as The Duke of Edinburgh's International Award - Australia, Australian Indigenous Ministries Inc., and others listed in the amendments, must now be included in the scheme, while some previously included institutions are omitted (Schedule 1, items 1–26). Compliance involves updating records, internal policies, and any public-facing information to reflect these changes accurately. Failure to comply with the updated list of institutions may result in legal consequences. While the specific offences and penalties are not detailed within the provided text, it is reasonable to infer that non-compliance could lead to administrative penalties, legal challenges, or other enforcement actions under the National Redress Scheme for Institutional Child Sexual Abuse Act 2018. The precise penalties would depend on the nature and severity of the non-compliance, as well as any relevant case law or statutory provisions.
