  This instrument is the National Redress Scheme for Institutional Child Sexual Abuse Amendment (2020 Measures No. 7) Declaration 2020.

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Overview

The National Redress Scheme for Institutional Child Sexual Abuse Amendment (2020 Measures No. 7) Declaration 2020, enacted by Anne Ruston, the Minister for Families and Social Services, aims to address gaps and issues in the existing legislative framework related to institutional child sexual abuse. The primary purpose of this amendment is to expand the scope of institutions covered under the National Redress Scheme to include additional entities that have been identified as having participated in or enabled such abuse. The amendment was made under the authority of the National Redress Scheme for Institutional Child Sexual Abuse Act 2018, which seeks to provide a national scheme to deliver timely, fair and appropriate redress to victims of institutional child sexual abuse. The enacting body for this declaration is the Parliament of Australia, with the intent to ensure that the redress scheme is comprehensive and inclusive of all relevant institutions implicated in historical child sexual abuse cases.

Scope and Application

The National Redress Scheme for Institutional Child Sexual Abuse Amendment (2020 Measures No. 7) Declaration 2020, made under the National Redress Scheme for Institutional Child Sexual Abuse Act 2018, applies to the Trustees of the Sisters of Mercy (North Sydney) institutions and the Presbyterian Church of Victoria Trusts Corporation. These entities, along with several other religious and charitable organisations, are listed in the Schedule to the Declaration and are amended to include additional institutions and entities as specified. The geographic reach of the Act is national, as it pertains to institutions operating across various states in Australia. The Declaration also includes exclusions and limitations, such as the extent to which certain institutions operated within Australia and the specific periods of operation. The commencement of the amendments is staggered, with some provisions taking effect immediately after the Declaration's registration and others on specified dates. The Act can be further extended or restricted through subordinate instruments, which may introduce additional entities or modify existing entries.

The National Redress Scheme for Institutional Child Sexual Abuse Amendment (2020 Measures No. 7) Declaration 2020 introduces amendments to the existing National Redress Scheme for Institutional Child Sexual Abuse Act 2018. The primary changes include the addition of new institutions and specific trustees to the list of covered entities, thereby expanding the scope of the Scheme to include more institutions and trustees that were previously not covered. For instance, sections 11 and 15 of the Act are amended to include the Trustees of the Sisters of Mercy (North Sydney) institutions and The Presbyterian Church of Victoria Trusts Corporation, along with various other specific institutions and trustees (see Schedule 1, items 1-17). The amendments are designed to ensure a broader range of institutions and trustees are held accountable and that affected individuals have access to the redress mechanisms provided by the Scheme. Failure to comply with the provisions of the National Redress Scheme can result in legal consequences. The Act includes provisions for civil and criminal penalties for non-compliance, including fines and potential imprisonment. For example, under section 20 of the Act, an individual or entity found to have wilfully obstructed or failed to comply with the Scheme’s requirements could face significant fines. The maximum penalties can vary depending on the severity of the breach and whether it is a first-time or repeat offence.
