Overview

The National Redress Scheme for Institutional Child Sexual Abuse Amendment (2020 Measures No. 6) Declaration 2020I was enacted to amend the National Redress Scheme for Institutional Child Sexual Abuse Act 2018, addressing the gap in redress for victims of institutional child sexual abuse. This instrument was made by Anne Ruston, Minister for Families and Social Services, under the authority of the National Redress Scheme for Institutional Child Sexual Abuse Act 2018, and aims to expand the list of institutions eligible for inclusion in the National Redress Scheme. The Declaration came into effect on the day after its registration and includes amendments to various sections and schedules to incorporate additional institutions and entities into the scheme, thereby broadening the scope of potential redress for affected individuals. The policy objective of this legislation is to ensure a comprehensive redress scheme that acknowledges and provides support for all victims of institutional child sexual abuse, enhancing the overall effectiveness of the National Redress Scheme.

Scope and Application

The National Redress Scheme for Institutional Child Sexual Abuse Amendment (2020 Measures No. 6) Declaration 2020 pertains to the Australian Commonwealth, specifically amending the National Redress Scheme for Institutional Child Sexual Abuse Act 2018. This amendment extends the application of the Act to include additional institutions involved in child sexual abuse, ensuring that survivors have access to the redress scheme. The amendment adds specific institutions and entities to the list of those covered by the Scheme, thereby broadening its scope to include more victims of institutional child sexual abuse. The amendments are effective from the day after the instrument is registered, as stipulated in the commencement provisions. There are no specific exclusions or exemptions outlined in this amendment, though the Act itself may contain provisions that exclude certain conduct or transactions. The application of the Act is not restricted by geographic boundaries within Australia, as it is a Commonwealth Act. Any further extensions or restrictions to the application of the Act would be governed by subordinate instruments or additional amendments as required.

Key Provisions

The National Redress Scheme for Institutional Child Sexual Abuse Amendment (2020 Measures No. 6) Declaration 2020 introduces amendments to the existing legislation, with particular focus on broadening the scope of institutions covered under the National Redress Scheme. The key operative sections include amendments to Section 11, Section 11C, Subsection 15(1), and Schedule 1, which introduce new institutions into the list of those eligible for redress under the scheme. Specifically, Section 11 now includes additional institutions operated by Life Church Queensland Ltd and Daughters of Our Lady of the Sacred Heart. Section 11C has been updated to include a wider range of table items (164-167, 176, and 184-195). Subsection 15(1) has been revised to remove specific references to paragraphs (a) and (b), and additional institutions have been added to the list in Subsection 15(1). These amendments impose obligations on the specified institutions to participate in the National Redress Scheme and to comply with any associated requirements, including the provision of information and support to victims of child sexual abuse. Institutions must ensure that they are properly registered and are aware of their responsibilities under the scheme. This includes making necessary disclosures and cooperating with the relevant authorities to facilitate the redress process. Failure to comply with the provisions of the amended legislation may result in legal consequences. While specific offences and penalties are not detailed in the text provided, breaches of similar legislative requirements typically result in fines, potential criminal charges, or other civil liabilities. Under Australian law, penalties for non-compliance with legislative requirements can vary significantly depending on the severity and intent of the breach. For more severe breaches, penalties could include substantial fines and imprisonment. Therefore, institutions must take the requirements of this amendment seriously and ensure full compliance to avoid any legal repercussions.
