Overview

The National Redress Scheme for Institutional Child Sexual Abuse Amendment (2020 Measures No. 18) Declaration 2020I was made by Anne Ruston, the Minister for Families and Social Services, under the National Redress Scheme for Institutional Child Sexual Abuse Act 2018. This legislative instrument was enacted to address gaps and issues in the original National Redress Scheme for Institutional Child Sexual Abuse Declaration 2018. The National Redress Scheme for Institutional Child Sexual Abuse Amendment (2020 Measures No. 18) Declaration 2020I amends the National Redress Scheme for Institutional Child Sexual Abuse Declaration 2018. The instrument is made under the authority of the National Redress Scheme for Institutional Child Sexual Abuse Act 2018. Certain sections and amendments in the Schedule to the 2018 Declaration commenced the day after the instrument is registered, while others commenced immediately after the commencement of the earlier provisions. The amendments expand the list of institutions covered by the scheme to include various entities and institutions that have been identified as being relevant to the scheme. The Act imposes obligations on participating entities to provide information, cooperate with the scheme, and ensure that they are compliant with the scheme’s requirements. Participating entities must provide information about their operations, including details about their institutional child sexual abuse policies, practices, and any incidents of abuse that have occurred. They must also cooperate with the scheme by providing access to records, staff, and facilities as required, and by participating in any investigations or reviews conducted by the scheme. Breach of the obligations imposed by the Act may result in civil or criminal penalties. Under the Act, a person who fails to provide information or cooperate with the scheme may be liable to a civil penalty of up to $11,000 for each day of the breach. In addition, a person who is found to have committed an offence under the Act may be liable to a criminal penalty of up to $550,000 for an individual or $2.75 million for a body corporate, or both. The Act also provides for the imposition of other civil or criminal penalties, including fines and imprisonment, for breaches of the scheme’s requirements or for conduct that is fraudulent or dishonest.
