Overview

The National Redress Scheme for Institutional Child Sexual Abuse Amendment (2020 Measures No. 17) Declaration 2020 was enacted to amend the National Redress Scheme for Institutional Child Sexual Abuse Act 2018. The legislation was introduced to address the need to include additional institutions and make minor adjustments to the existing scheme to ensure comprehensive coverage and effective redress for victims of institutional child sexual abuse. The amendments were enacted by Anne Ruston, the Minister for Families and Social Services, and they aim to further the policy objective of providing a national redress scheme that offers support and compensation to victims, while also promoting transparency and accountability among institutions. The Declaration amends the original Act by adding new institutions to the list of those covered under the scheme, ensuring that a broader range of entities are included for potential redress claims. Additionally, it makes technical adjustments to the existing provisions to refine the operation of the scheme. The amendments were authorised under various subsections of the original Act, including sections 115(2), 116(2), 119, 127(1), 134(1), and 137(1). The Declaration came into effect on specified dates as outlined in the commencement provisions, ensuring that the changes are implemented in a structured and orderly manner.

Scope and Application

The National Redress Scheme for Institutional Child Sexual Abuse Amendment (2020 Measures No. 17) Declaration 2020 pertains to the amendment of the National Redress Scheme for Institutional Child Sexual Abuse Declaration 2018. This legislation applies to a range of entities, including religious and educational institutions that have been implicated in cases of institutional child sexual abuse. The amendment extends the scope of the scheme to include additional institutions, such as those affiliated with the Christian Reformed Churches of Australia Synodical Board of Management and the Order of the Capuchin Friars Minor, among others. The geographic reach of this amendment is national, as it operates under the Commonwealth jurisdiction. The commencement of the provisions is staggered, with certain sections and amendments taking effect immediately upon registration, while others follow suit shortly thereafter. The Act does not explicitly outline exclusions or thresholds but does specify a range of institutions through amendments detailed in the schedules. Subordinate instruments may further define or restrict the application of this legislation as necessary.

Key Provisions

The National Redress Scheme for Institutional Child Sexual Abuse Amendment (2020 Measures No. 17) Declaration 2020I, issued by Anne Ruston, Minister for Families and Social Services, amends the National Redress Scheme for Institutional Child Sexual Abuse Declaration 2018. The instrument outlines the changes and additions to be implemented in accordance with the National Redress Scheme for Institutional Child Sexual Abuse Act 2018. The amendments concern the entities that must comply with the National Redress Scheme for Institutional Child Sexual Abuse and the redress arrangements applicable to these entities. The operative sections of the instrument detail the commencement of the amendments, with specific provisions commencing on the day after registration, and others taking effect immediately after the commencement of the initial provisions. The amendments add new institutions and entities to the scheme, such as the Christian Reformed Churches of Australia Synodical Board of Management institutions and the Order of the Capuchin Friars Minor institution. The instrument also adjusts the table items to reflect the inclusion of new institutions and the exclusion of some existing ones. The obligations imposed by the Act on the entities governed by it include the requirement to comply with the National Redress Scheme for Institutional Child Sexual Abuse. This involves adhering to the redress arrangements and participating in the scheme, which provides a framework for addressing claims related to institutional child sexual abuse. The amendments ensure that the scheme covers a broader range of institutions and entities, thus expanding its scope and ensuring that more victims have access to redress. Breaches of the obligations and requirements set out in the Act may lead to various consequences. While the instrument does not explicitly state the penalties for non-compliance, it is likely that the Act provides for both civil and criminal penalties. These could include fines, imprisonment, or other legal actions against entities that fail to comply with the scheme's requirements. The specific penalties would be outlined in the main Act, and it is essential for the governed entities to adhere to the provisions to avoid such consequences.
