Overview

The National Primary Production Work Diary Exemption (Notice) 2015 (No. 1) was introduced to address the administrative burden faced by drivers of fatigue-regulated heavy vehicles engaged in primary production work, particularly those operating within a radius of 160 kilometres or less from their base. The Notice was enacted to alleviate the requirement for these drivers to keep and record information in a National Driver Work Diary, while ensuring compliance with relevant fatigue management regulations. This Notice was issued under Section 357 of the Heavy Vehicle National Law (HVNL) by Salvatore Petroccitto, the delegate of the National Heavy Vehicle Regulator. The policy objective is to facilitate more efficient and streamlined operations for drivers involved in primary production activities, thereby enhancing productivity and reducing unnecessary paperwork. This legislative instrument applies to specific jurisdictions and has a defined commencement and expiration date to ensure clarity and consistency in its application. It exempts drivers from the work diary requirements on the condition that the record keeper complies with the stipulated sections of the HVNL. This Notice is designed to provide relief to drivers engaged solely in primary production work within the specified radius, thereby addressing a gap in the existing regulatory framework.

Scope and Application

The Heavy Vehicle National Law National Primary Production Work Diary Exemption (Notice) 2015 (No. 1) serves to exempt drivers of fatigue-regulated heavy vehicles engaged in primary production work from the requirement to maintain and record information in a National Driver Work Diary, provided the driver operates within a radius of 160 kilometres or less from their base. This Notice applies specifically to drivers who are solely undertaking primary production work on a given day and who comply with the conditions outlined in Section 11 of the Notice. This exemption is applicable in jurisdictions such as Tasmania, South Australia, the Australian Capital Territory, New South Wales, and Queensland, where the Notice was implemented at varying dates, with an expiration set for 31 December 2017. The scope of this exemption is contingent on the record keeper for the driver adhering to the requirements of Section 319 of the Heavy Vehicle National Law concerning the recording and retention of specified information for the class of work to which this notice pertains.

Key Provisions

This Notice, issued in accordance with Section 357 of the Heavy Vehicle National Law (HVNL), exempts drivers of fatigue-regulated heavy vehicles engaged in primary production work from the obligation to maintain and record information in a National Driver Work Diary (Section 9). This exemption applies if the driver is operating within a 160-kilometre radius from their base and only performs the specified class of work on a given day (Section 10). To qualify for this exemption, the driver’s record keeper must adhere to Section 319 of the HVNL in terms of recording and maintaining the relevant information for the class of work covered by this Notice (Section 11). Under this Notice, the key obligation for drivers is to ensure that their work is confined within the 160-kilometre radius from their base and exclusively pertains to primary production activities (Section 9). Additionally, the record keeper must comply with the requirements set out in Section 319 of the HVNL for the recording and retention of specified information (Section 11). The Notice mandates that the exemption is applicable only if the driver engages in the specified class of work without undertaking any other work outside this category on the same day (Section 10). In terms of enforcement and compliance, Section 357 of the HVNL provides the legal basis for this Notice, and any breach of the conditions outlined in this Notice may result in penalties as stipulated in the HVNL. Although the Notice does not specify particular penalties, the general provisions of the HVNL would apply, including potential fines and other civil or criminal consequences for non-compliance. The maximum penalties under the HVNL can vary depending on the severity of the offence, but they can include substantial fines and, in some cases, imprisonment. The Notice exempts eligible drivers from specific requirements under Subdivisions 1 to 5 of Division 2 of Part 6.4 of Chapter 6 of the HVNL, but it is explicitly conditional on compliance with the recording and retention obligations specified in Section 319 of the HVNL (Section 11). The exemption is subject to the condition that the record keeper for the driver complies with these obligations, ensuring that all relevant information is properly recorded and maintained. This condition is crucial for the validity of the exemption and must be adhered to strictly to avoid any repercussions. This Notice will be in effect from 6 February 2015 in Tasmania, South Australia, and the Australian Capital Territory, and from 4 May 2015 in New South Wales and Queensland (Sections 6 and 7). It will expire on 31 December 2017 in all jurisdictions where it applies (Section 8). During this period, the provisions of this Notice will govern the exemption of fatigue-regulated heavy vehicle drivers engaged in primary production work from the National Driver Work Diary requirements, subject to the conditions specified.
