EXPLANATORY STATEMENT

STATUTORY RULES 1987 No. 79

NATIONAL PARKS AND WILDLIFE REGULATIONS (AMENDMENT)

(Issued under the authority of the Minister of State for Arts, Heritage and Environment)

The purpose of the National Parks and Wildlife Regulations (Amendment) was to generally prescribe certain activities to exclude them from application of the prohibition on operations for the recovery of minerals in Kakadu National Park imposed by sub-section 10(1A) of the NationaI Parks and Wildlife Conservation Act 1975 (the Act).

Regulation 2AA.

Prescribes 8 routes for the purposes of sub section 3A(2)(g) of the Act (including air routes). The transport of anything along such routes therefore does not constitute “operations for the recovery of minerals” as prohibited by sub-section 10(1A) of the Act.

Regulation 2AB

Prescribes 3 routes for the purposes of sub section 3A(2)(c) of the Act (one pipeline and two powerline routes) so that the construction or use of pipelines or powerlines along such routes does not constitute “operations for the recovery of minerals” as prohibited by sub-section 10 (1A) of the Act.

Regulation 2AC

Prescribes the non-destructive monitoring of the environment for the purposes of sub section 3A(2)(d) of the Act so that such monitoring does not constitute “operations for the recovery of mineralsas prohibited by sub-section 10(1A) of the Act.
