EXPLANATORY STATEMENT
STATUTORY RULES 1987 No. 139
NATIONAL PARKS AND WILDLIFE REGULATIONS (AMENDMENT)
(Issued under the authority of the Minister for Arts, Heritage and Environment).
The purpose of the National Parks and Wildlife Regulations (Amendment) is generally to provide protection to certain wildlife in specified Commonwealth areas and enable the Commonwealth to implement more effectively the two bilateral agreements on migratory birds and birds in danger of extinction entered into by the Commonwealth Government with the Governments of Japan and People’s Republic of China. The major provisions of the amendments establish a system of licencing and records keeping designed to facilitate the conservation of specified wildlife

Regulation 4
Amends existing Regulations by inserting Part III to provide for the conservation of specified wildlife in the following manner:
• | Regulation 16AA | Formal. Provides for interpretation. |
• | Regulation 16AB | Specifies Commonwealth areas to which Part III applies. |
• | Regulation 16AC | Provides for a licence to be required and specifies the types of information required to accompany a written application. |
• | Regulation 16AD | Sets out the matters to which the Director must have regard when considering whether to grant a licence and enables the Director to attach certain conditions to a licence. |
• | Regulation 16AE | Provides for a licence to remain in force for a period of one year. |
• | Regulation 16AF | Enables the Director under certain circumstances to suspend a licence for a period of 28 days. |
• | Regulation 16AG | Enables the Director, under certain circumstances to cancel a licence. |
• | Regulation 16AH | Provides for a licensee, with the consent of the Director, to authorise a person to carry on activities in accordance with a licence. This Regulation also sets out circumstances under which the consent of the Director shall not be given. |
• | Regulation 16AI | provides for certain unauthorised activities to be an offence with an attendant penalty. |
• | Regulation 16AJ | Provides for a licensee authorised to keep a protected animal to also keep for the animal a record that registers certain specified information which must be kept for a period of 3 years. |
• | Regulation 16AK | Enables a warden or ranger to enforce the provisions of Part III of the National Parks and Wildlife Regulations. |
Regulations 16AH and 16AJ each provide for penalties for failure to comply with certain of their respective provisions.
