EXPLANATORY STATEMENT

STATUTORY RULES 1986 NO. 226

NATIONAL PARKS AND WILDLIFE REGULATIONS (AMENDMENT)

(Issued under the authority of the Minister of State for Arts, Heritage and Environment)

The purpose of the National Parks and Wildlife Regulations (Amendment) is generally to provide a uniform administrative base for the granting, by the Director of National Parks and Wildlife, of permits to fish in Kakadu National Park. The proposed amendments to Regulation 10 remove the requirement for the Director to issue a permit, on application, to the holder of a Northern Territory commercial fishing licence and provide the legal framework necessary to implement Plan of Management objectives of phasing out commercial fishing in Kakadu National Park. The proposed amendments allow the Director discretion in applying conditions deemed appropriate to any permit issued for fishing in Park or Reserves.

Existing Regulation 10 is amended by:

(a) omitting sub-regulation (1) which currently compels the Director to issue a fishing permit to the holder of a licence issued under the Fish and Fisheries Act 1979 of the Northern Territory;

(b) omitting from sub-regulation (2) “other than a person who is the holder of a licence”; so as to provide for only one procedure for the issue of a fishing permit.

(c) omitting from paragraph (5)(a) all the words after specified and substituting “in the permit”; - to remove reference to any period that might be referred to in a licence

(d) omitting paragraph (5)(b); to remove reference to any conditions that might be included in a licence

(e) omitting from paragraph (5)(c) “in any case - ”;

(f) omitting from paragraph (5)(c)(iii) all the words after “holder” and substituting “of the permit”, and to remove all reference to bag limits that may be imposed under the Fish and Fisheries Act

(g) omitting from sub-regulation (7) the definition of “licence”.
