Overview

The National Library Regulations 1974, made under the National Library Act 1960, were established to provide a framework for the administration of the National Library of Australia. The National Library Act 1960 created the National Library of Australia and set out its functions and objectives. However, the Act did not detail the administrative arrangements for the operation of the Library, necessitating the creation of these Regulations to fill that gap. The Regulations were enacted by the Parliament of Australia and aim to ensure that the Library operates efficiently and effectively within the parameters set by the Act. They include provisions for the allowances payable to the Director-General of the National Library, aligning these with those of a Senior Executive Service officer of the Australian Public Service. This legislative instrument was repealed by Statutory Rules 1994 No. 329, indicating updates or changes in administrative requirements over time.

Scope and Application

The National Library Regulations, established under the National Library Act 1960, govern the administration and operation of the National Library of Australia. These regulations apply to the Director-General of the National Library, prescribing specific allowances for this position, aligning it with the remuneration of a Senior Executive Service officer within the Australian Public Service. The regulations, as amended, set out the framework for the financial entitlements of the Director-General and ensure compliance with statutory provisions. The geographic reach of these regulations is national, applying across Australia, and they are enforced within the Commonwealth jurisdiction. The regulations were repealed by Statutory Rules 1994 No. 329, which suggests that subsequent amendments or reforms have superseded the 1974 regulations. While the primary focus is on the allowances for the Director-General, the regulations are integral to the effective governance of the National Library of Australia, ensuring alignment with broader public service standards.

Key Provisions

The National Library Regulations (1974, as amended) are subsidiary legislation made under the National Library Act 1960. These regulations provide specific details and rules to implement the overarching provisions of the Act. The regulations consist of a few key sections. The first section (section 1) establishes the title of the regulations, known as the National Library Regulations. The second section (section 2) defines key terms used within the regulations, with "the Act" referring to the National Library Act 1960. The third section (section 3) outlines the prescribed allowances for the Director-General of the National Library, which are set in line with those for a Senior Executive Service officer of the Australian Public Service, as per subsection 13(2) of the Act. The National Library Regulations impose several obligations and requirements on the entities they govern. For example, they specify the allowances for the Director-General of the National Library, ensuring that these allowances are in line with those provided to Senior Executive Service officers within the Australian Public Service. These allowances are crucial for maintaining the appropriate compensation framework for the leadership of the National Library, ensuring that the role is adequately remunerated to attract and retain capable leadership. By aligning these allowances with those of other senior public service roles, the regulations aim to maintain consistency and fairness in executive compensation across government agencies. Violations of the National Library Regulations can lead to various consequences, depending on the nature and severity of the breach. While the specific offences, penalties, and consequences are not detailed within the provided text of the regulations, it is reasonable to infer that breaches could potentially lead to administrative actions, legal proceedings, or other corrective measures as outlined in the National Library Act 1960. Given the regulatory nature of these rules, penalties might include fines, orders for compliance, or other sanctions deemed necessary to enforce the regulations and uphold the integrity of the National Library’s operations.
