Overview
The National Housing Finance and Investment Corporation (Acting Member) Appointment (No. 1) 2023 is a notifiable instrument made under the authority granted by the National Housing Finance and Investment Corporation Act 2018 and the Acts Interpretation Act 1901. Enacted by Julie Collins, who holds the positions of Minister for Housing, Minister for Homelessness, and Minister for Small Business, this instrument addresses the need to temporarily fill a position on the National Housing Finance and Investment Corporation Board. Specifically, it appoints Teresa Dyson as an acting member on a part-time basis, effective from 26 July 2023 until either 25 October 2023 or the next appointment of a substantive member, whichever occurs first. The policy objective of this appointment is to ensure continuity and stability in the Corporation’s leadership during a transitional period.
Scope and Application
The instrument appoints Teresa Dyson as an acting member of the National Housing Finance and Investment Corporation (NHFIC) Board on a part-time basis, effective from 26 July 2023 until the earlier of 25 October 2023 or the next substantive appointment of a member under the National Housing Finance and Investment Corporation Act 2018. This appointment is made under the authority granted by subsection 21(2) of the Act and subsection 33A(1) of the Acts Interpretation Act 1901. The remuneration and allowances for the acting member are set at the level applicable to a substantive member during the period of appointment. The scope of this instrument is limited to the appointment of an acting member and does not extend to broader regulatory or operational aspects of the NHFIC's functions. The instrument applies within the jurisdictional boundaries of the Commonwealth of Australia and is subject to the terms and conditions specified within the Act itself.
Key Provisions
The primary sections of the National Housing Finance and Investment Corporation (Acting Member) Appointment (No. 1) 2023 instrument (F2023N00218) focus on the appointment of Teresa Dyson as an acting member of the National Housing Finance and Investment Corporation Board. According to section 21(2) of the National Housing Finance and Investment Corporation Act 2018, Teresa Dyson is appointed to this role on a part-time basis, effective from 26 July 2023, until the earlier of 25 October 2023 or the next appointment of a substantive member under section 18 of the Act. Section 33A(1) of the Acts Interpretation Act 1901 supports the authority of this appointment. Additionally, section 21(2) of the Act stipulates that Teresa Dyson's remuneration and allowances during this period will be equivalent to those applicable to a full-time member of the Board.
This legislation imposes specific obligations on Teresa Dyson and the National Housing Finance and Investment Corporation Board. Teresa Dyson, as an acting member, must adhere to the duties and responsibilities outlined for Board members in the National Housing Finance and Investment Corporation Act 2018. This includes participating in meetings, contributing to decision-making processes, and acting in the best interests of the Corporation. The Board, in turn, must ensure that Teresa Dyson is provided with the necessary resources and support to fulfil her role effectively. The Corporation is also required to manage the transition between Teresa Dyson's acting appointment and any subsequent substantive appointment, ensuring continuity in its operations.
Failure to comply with the provisions of this instrument may lead to various consequences. While the specific offences and penalties are not detailed in this notifiable instrument, breaches of the National Housing Finance and Investment Corporation Act 2018 can generally result in civil or criminal penalties. Civil penalties can include fines up to a maximum amount determined by the relevant legislation, while criminal penalties might involve imprisonment, depending on the severity of the breach. The exact penalties would be governed by the broader provisions of the Act and any related legislation, and would be subject to the judicial process in the event of a breach. It is essential for all parties involved to ensure strict adherence to the terms and conditions set forth to avoid any legal repercussions.
