Overview
The Heavy Vehicle National Law (National Heavy Vehicle Standards (Semitrailer Rear Bumper) Exemption Notice 2016 (No.1)) was enacted to address a specific issue related to the requirements for the rear bumpers of semitrailers that were heavy vehicles and manufactured prior to 1 January 2005. This exemption notice was introduced under section 61 of the Heavy Vehicle National Law as in force in each participating jurisdiction, with the aim of providing relief to operators of older semitrailers from the Australian Design Rule (ADR) requirement for the rear bumper to be painted white. The notice was created by the National Heavy Vehicle Regulator, with an explicit policy objective of ensuring that these older vehicles remain compliant with all other relevant standards while addressing a particular regulatory burden. This exemption notice commenced on 19 February 2016 and is set to expire on 18 February 2021, providing a temporary solution to the identified problem.
Scope and Application
The National Heavy Vehicle Standards (Semitrailer Rear Bumper) Exemption Notice 2016 (No. 1) applies to semitrailers classified as heavy vehicles that were manufactured prior to 1 January 2005. It is applicable across all jurisdictions participating in the Heavy Vehicle National Law, which is implemented in a harmonised manner across the Commonwealth of Australia, including states and territories. This notice provides an exemption from specific requirements under the Heavy Vehicle (Vehicle Standards) National Regulation, notably exempting such vehicles from the mandatory requirement for their rear bumpers to be painted white. This exemption is conditional upon the vehicle displaying some other compliant marking on the next rearmost part of the vehicle if the bumper is the rearmost part. The notice does not exempt these vehicles from complying with other relevant standards under the ADRs. It is effective as of 19 February 2016 and will expire on 18 February 2021, unless further extended or amended by subordinate instruments.
Key Provisions
The key operative sections of the National Heavy Vehicle Standards (Semitrailer Rear Bumper) Exemption Notice 2016 (No. 1) are set out in sections 7 and 8. Section 7(2) specifies the application of the notice to semitrailers that are heavy vehicles and were manufactured to comply with Australian Design Rules (ADR) 42/00, 42/01, 42/02 or 42/03. Section 8 provides the exemption from certain prescribed vehicle standards, specifically the requirement for the rear bumper to be painted white, for semitrailers manufactured prior to 1 January 2005. The notice also specifies that if the bumper is the rearmost part of a vehicle, the vehicle must display some other marking that complies with section 30 of Schedule 2 of the Heavy Vehicle (Vehicle Standards) National Regulation on the next rearmost part of the vehicle.
The notice imposes several obligations and requirements on the parties it governs. Firstly, it applies in all participating jurisdictions and only to semitrailers that are heavy vehicles and were manufactured to comply with ADR 42/00, 42/01, 42/02 or 42/03. Secondly, it exempts these semitrailers from the requirement to have a white painted rear bumper. However, the notice also requires that if the bumper is the rearmost part of a vehicle, the vehicle must display some other marking that complies with section 30 of Schedule 2 of the Heavy Vehicle (Vehicle Standards) National Regulation on the next rearmost part of the vehicle. The notice is in force until 18 February 2021, and during this period, it is the responsibility of the owner or operator of the semitrailer to ensure compliance with its provisions.
There are no specific offences, penalties, or civil/criminal consequences outlined in the notice for breach of its provisions. However, non-compliance with the Heavy Vehicle National Law (HVNL) or the Heavy Vehicle (Vehicle Standards) National Regulation could result in offences, penalties, or civil/criminal consequences. For example, under the HVNL, a person who contravenes a prescribed vehicle standard may be guilty of an offence and liable to a penalty of up to $12,600 for an individual or $63,000 for a body corporate. Similarly, under the Heavy Vehicle (Vehicle Standards) National Regulation, a person who contravenes a prescribed vehicle standard may be guilty of an offence and liable to a penalty of up to $12,600 for an individual or $63,000 for a body corporate. It is important for owners and operators of semitrailers to ensure compliance with all relevant legislation to avoid these potential consequences.
