HEAVY VEHICLE NATIONAL LAW

NATIONAL HEAVY VEHICLE STANDARDS (SEMITRAILER REAR BUMPER) EXEMPTION NOTICE 2016 (NO.1)

  1. Purpose

The purpose of this notice is to exempt semitrailers that are heavy vehicles and were manufactured prior to 1 January 2005 from complying with the Australian Design Rule (ADR) requirement for the rear bumper to be painted white.

2.      Authorising Provision

This notice is made under section 61 of the Heavy Vehicle National Law (HVNL) as in force in each participating jurisdiction.

3.       Commencement

This notice commences on 19 February 2016.

4.      Expiry

This notice expires on 18 February 2021.

5.      Definitions

Unless otherwise stated, words and expressions used in this notice have the same meanings as those defined in the HVNL and the ADRs.

6.       Title

This notice may be cited as the National Heavy Vehicle Standards (Semitrailer Rear Bumper) Exemption Notice 2016 (No. 1).

7.      Application

(1)    This notice applies in all participating jurisdictions.

(2)    This notice applies to semitrailers that are heavy vehicles and manufactured to comply with Australian Design Rule (ADR) 42/00, 42/01, 42/02 or 42/03.

8.      Exemption from Prescribed Vehicle Standards

(1)    A heavy vehicle described in section 7(2), is exempt from complying with the following requirements of the Heavy Vehicle (Vehicle Standards) National Regulation (the Regulation):

  1. Schedule 1 Section 2(1), insofar as it requires:
  1. for a semitrailer manufactured to comply with ADR42/03 or ADR42/02, the requirement for the rear bumper to be painted white, in accordance with clause 9.1.2 of the ADR;
  2. for a semitrailer manufactured to comply with ADR42/01 or ADR42/00, the requirement for the rear bumper to be painted white, in accordance with clause 42.6.1.2 of the ADR.

b.      Schedule 2 Section 30 if the bumper is the rearmost part of a vehicle, on condition that the vehicle displays some other marking that complies with this section on the next rearmost part of the vehicle.

9.      Conditions

(a)    The vehicle must continue to comply with all other requirements of relevant version of ADR 42.
