HEAVY VEHICLE NATIONAL LAW
NATIONAL HEAVY VEHICLE STANDARDS (QUEENSLAND CONDITIONAL REGISTRATION) EXEMPTION (NOTICE) 2014 (No. 1)
Purpose
- The purpose of this notice is to exempt heavy vehicles that are eligible for conditional registration in Queensland from particular requirements of the Heavy Vehicle (Vehicle Standards) National Regulation (the National Regulation).
Authorising Provision
2. This notice is made under section 61 of the Heavy Vehicle National Law (the National Law) as in force in Queensland.
Commencement
3. This notice commences on the date it is published.
Expiry
4. This notice expires 5 years after it is published.
Definitions
5. Unless otherwise stated, words and expressions used in this notice have the same meanings as those defined in the National Law.
6. In this notice:
Queensland Catalogue means the Non-Complying Vehicle Catalogue maintained by the Department of Transport and Main Roads (Queensland), as amended from time to time. The Catalogue is maintained on the Department of Transport and Main Roads (Queensland) website, and may be accessed via the link provided in Appendix#1 of this Notice.
Conditional Registration means conditional registration in Queensland pursuant to the requirements of the Guideline for Conditionally Registered Vehicles in Queensland.
Queensland Guideline means the Guideline for Conditionally Registered Vehicles in Queensland, approved by the Chief Executive of the Department of Transport and Main Roads (Queensland) or his delegate, as amended from time to time.
Title
7. This notice may be cited as the National Heavy Vehicle Standards (Queensland Conditional Registration) Exemption (Notice) 2014 (No. 1).
Application
8. This Notice applies only in Queensland.
9. This notice applies to heavy vehicles that are listed in the Queensland Catalogue.
Exemption from Prescribed Vehicle Standards
10. A heavy vehicle, described in clause 9 is exempt from complying with the requirements of Schedule 2 of the National Regulation and those vehicle standards listed in section 7 of the Queensland Guideline.
Conditions
11. A heavy vehicle operating under this notice must comply with all the conditions imposed by the Queensland Guideline.
Declaration
I, Melinda Bailey, delegate of the National Heavy Vehicle Regulator hereby exempt the heavy vehicles specified in this notice from the stated requirements of the Heavy Vehicle (Vehicle Standards) National Regulation to the extent and on the conditions specified in this notice.
