Overview

The Heavy Vehicle National Law, enacted in 2012, was introduced to create a consistent regulatory framework across Australia for heavy vehicle operations. This law aims to enhance road safety and productivity by standardising heavy vehicle regulations, licensing, and enforcement across the country. The law is administered by the National Heavy Vehicle Regulator, which was established to oversee the implementation and enforcement of the provisions set forth in the Heavy Vehicle National Law and related regulations. The policy objective is to ensure uniformity in the regulation of heavy vehicles, thereby reducing compliance burdens and enhancing the safety and efficiency of heavy vehicle operations nationwide. The gazette issued under the authority of Section 740A(4) of the Heavy Vehicle National Law sets out the prescribed fees for the National Heavy Vehicle Regulator for the 2026/27 financial year. These fees apply to various applications related to accreditation, permits, and renewals, such as maintenance management accreditation, mass management accreditation, and exemptions for mass or dimensions. The fees are designed to cover the costs associated with processing these applications and ensuring compliance with the regulatory requirements. Effective from 1 July 2026, these fees are an essential component of the regulatory framework, ensuring that the National Heavy Vehicle Regulator can continue to perform its functions efficiently.

Scope and Application

The Heavy Vehicle National Law applies to operators of heavy vehicles across Australia, encompassing both individuals and entities engaged in heavy vehicle operations. The law governs the accreditation processes for maintenance management, mass management, and fatigue management, as well as applications related to vehicle mass, dimensions, and exemptions. It mandates the prescribed fees for various applications, including accreditation, permit applications, and renewals, which are outlined in Schedule 1 of the Notice. The fees outlined in this Notice take effect on 1 July 2026 and are set forth by the National Heavy Vehicle Regulator under the authority of section 740A(4) of the Heavy Vehicle National Law. This regulatory framework ensures that all heavy vehicle operations comply with national standards and regulations, thereby maintaining road safety and productivity standards across the country. The application of this law is national in scope, covering all states and territories within Australia.

Key Provisions

The main operative sections of the C2026G00412 Gazette Notice set out the prescribed fees for the 2026/27 financial year under the Heavy Vehicle National Law (s740A(4)). These fees apply to various applications made by operators of heavy vehicles and drivers of fatigue-regulated heavy vehicles. For instance, the fees cover applications for maintenance management accreditation (s459(1)), mass management accreditation (s459(1)), BFM accreditation (s459(1)), AFM accreditation (s459(1)), written work diary authorisation (s339(1)), and applications for mass or dimension exemptions (s123(1)) or class 2 heavy vehicle authorisations (s144(1)). These fees are outlined in Schedule 1 of the Notice and will take effect from 1 July 2026. The obligations and requirements imposed by the Act on the parties it governs include the timely payment of the prescribed fees for the relevant applications. Operators of heavy vehicles must pay the specified fees for applications related to maintenance management accreditation, mass management accreditation, BFM accreditation, and AFM accreditation. Similarly, drivers of fatigue-regulated heavy vehicles must pay the fee for written work diary authorisation, and both operators and drivers must pay the fees for applications related to mass or dimension exemptions and class 2 heavy vehicle authorisations. These fees must be submitted as per the details provided in Schedule 1 of the Notice, which lays out the specific amount for each type of application. There are no explicit offences, penalties, or civil/criminal consequences mentioned for breach of the fees in the provided text of the Notice. However, the Act likely includes provisions that require compliance with the fee schedule, and failure to pay the prescribed fees could result in delays or refusals in processing applications. Given the regulatory nature of the Heavy Vehicle National Law, it is reasonable to infer that non-compliance with the fee requirements could lead to administrative penalties or other consequences as stipulated in the broader legislative framework.
