Overview

The Heavy Vehicle National Law, enacted in 2012, was introduced to create a unified regulatory framework for heavy vehicles across Australia, addressing the prior inconsistencies and gaps in state and territory laws. The law is administered by the National Heavy Vehicle Regulator, established under section 740A of the Heavy Vehicle National Law. The regulator is tasked with ensuring compliance and safety in the heavy vehicle industry, with a clear policy objective of reducing the risk of road accidents and improving the efficiency of heavy vehicle operations across the country. In line with this objective, the National Heavy Vehicle Regulator has prescribed fees for the 2024/25 financial year, effective from 1 July 2024, to cover various applications and accreditations related to heavy vehicle management and operation, ensuring that the industry adheres to the required safety and productivity standards.

Scope and Application

The Heavy Vehicle National Law, as amended by the Gazetted Schedule C2024G00360, sets out prescribed fees for the financial year 2024/25 that apply to various applications and accreditations related to heavy vehicle operations in Australia. This legislation applies to heavy vehicle operators and drivers involved in fatigue-regulated heavy vehicle operations, mass or dimension exemptions, and heavy vehicle authorisations. The fees prescribed under the Heavy Vehicle (General) National Regulation, detailed in Schedule 1 of the Notice, cover applications for maintenance management accreditation, mass management accreditation, BFM and AFM accreditation, written work diaries, mass or dimension exemptions, and class 2 heavy vehicle authorisations. The fees take effect from 1 July 2024 and are enforced nationally, reflecting a uniform regulatory approach across all states and territories of Australia. Exclusions and exemptions from these fees are not explicitly mentioned in the Notice, indicating that all specified applications are subject to the prescribed fees unless otherwise stated through subordinate instruments.

Key Provisions

Section 740A(4) of the Heavy Vehicle National Law specifies the prescribed fees for various applications related to the regulation of heavy vehicles for the financial year 2024/25. These fees are detailed in Schedule 1 of the Notice and will be effective from 1 July 2024. For example, an application for maintenance management accreditation by an operator of a heavy vehicle costs $1,072. Similarly, an application to add vehicles to or change vehicles under existing maintenance management accreditation is $39 per vehicle. The fees vary depending on the type of application, such as those for mass management accreditation, BFM accreditation, AFM accreditation, written work diaries, mass or dimension exemptions, and class 2 heavy vehicle authorisations. Operators of heavy vehicles are required to pay these prescribed fees when making applications for various accreditations and permits. For instance, operators seeking maintenance management accreditation must pay $1,072, while those wishing to add or change vehicles under existing accreditation must pay $39 per vehicle. Drivers of fatigue-regulated heavy vehicles must pay $30 for a written work diary. Operators applying for mass or dimension exemptions or renewals, as well as those applying for class 2 heavy vehicle authorisations or renewals, must pay $88 for each application. These fees are mandatory and must be paid in accordance with the schedule set out in the Notice. Breaching the provisions of the Heavy Vehicle National Law by failing to pay the prescribed fees when required can result in various consequences. While the Notice does not explicitly state the penalties for non-compliance, the failure to pay the required fees may result in the non-approval or non-renewal of the relevant accreditations or permits. This could potentially lead to operational disruptions for heavy vehicle operators and drivers. It is important for operators to ensure they adhere to the fee requirements to avoid any potential legal or operational issues.
