Scope and Application

This means that while the Notice exempts these individuals from certain regulatory requirements, it also imposes the requirement for them to adhere to the specific work record management system established by their employing emergency service. The Notice includes provisions for offences, penalties, and civil or criminal consequences for breach. Although the Notice itself does not explicitly state penalties for non-compliance with its provisions, breaches of the Heavy Vehicle National Law (HVNL) or its regulations, from which this Notice derives its authority, may incur penalties. Under section 356 of the HVNL, an individual who contravenes a requirement of the HVNL or its regulations may be liable for a penalty of up to 5,000 penalty units for an individual and 25,000 penalty units for a body corporate. Furthermore, section 358 of the HVNL provides that in the case of a continuing failure to comply with a requirement of the HVNL or its regulations, a penalty of up to 1,000 penalty units for an individual and 5,000 penalty units for a body corporate may be imposed for each day of the failure. It is important to note that the Notice does not relieve drivers of fatigue regulated heavy vehicles from the duty to avoid driving while fatigued, as stated in section 1(3) of the Notice, nor does it provide an exemption to work and rest requirements or any safety duties under the HVNL.
