Overview
Statutory Rules 1975 No. 207, which were made under the National Health Act 1953, represent an amendment to the National Health Regulations, specifically addressing the prescribed amount under various sections of the Act. Enacted by the Governor-General of Australia, acting on the advice of the Executive Council, these Regulations came into operation on 13 November 1975. The amendment repeals Regulation 20ba and substitutes it with a new regulation prescribing an amount of $5.65 for purposes outlined in several subsections of the Act. This legislative instrument aims to update the financial parameters within the health sector, ensuring that specific provisions of the National Health Act are accurately reflected in the regulatory framework. The underlying policy objective is to maintain consistency and clarity in the application of financial regulations within the health system.
Scope and Application
The Statutory Rules 1975 No. 207 under the National Health Act 1953-1975 provides specific regulatory amendments to the National Health Regulations, coming into effect on 13 November 1975. These regulations govern a range of provisions under the National Health Act and are designed to modify the prescribed amount related to certain health-related fees and charges. The application of these regulations is national in scope, impacting all entities and individuals subject to the National Health Act across Australia. Notably, Regulation 20ba is repealed and replaced to establish a prescribed amount of $5.65 for various subsections and clauses within the Act, thereby affecting entities and individuals who are subject to those particular health-related fees and charges. The regulations do not specify any exclusions or exemptions, and the prescribed amount applies uniformly across the Commonwealth, ensuring a consistent standard in the application of health fees and charges as stipulated by the Act.
Key Provisions
The Statutory Rules 1975 No. 207, made under the National Health Act 1953-1975, introduce amendments to the National Health Regulations. The Regulations come into operation on 13 November 1975. Specifically, Regulation 20ba is repealed and substituted with a new regulation prescribing an amount of $5.65 for various purposes (reg. 2). This prescribed amount applies to several provisions of the Act, including sub-paragraph 57b(2)(b)(ii), clause 73c(3)(a)(ii)(c), and paragraphs 82d(4)(b), 82s(4b)(b), 82t(7)(b), and 82W(7)(b).
Entities and individuals governed by these Regulations must ensure compliance with the prescribed amount of $5.65 as stipulated in the substituted Regulation 20ba. This requirement is essential for adherence to the provisions listed, ensuring that the financial obligations and entitlements under the Act are accurately reflected and applied. Proper record-keeping and accurate financial reporting will be necessary to meet these obligations effectively.
The Act does not explicitly outline specific offences, penalties, or consequences for non-compliance with these Regulations. However, any breach of the National Health Act 1953-1975 or its Regulations could potentially lead to enforcement actions, including fines or other legal consequences as provided under the parent Act. The precise penalties would depend on the nature and severity of the breach, as well as any additional provisions or regulations that may apply.
