Overview

The National Health (Application Fees for Pharmacist Approvals) Determination 2020 was enacted to establish fees for applications related to pharmacist approvals under the National Health Act 1953. This legislative instrument was made under subsection 90(10) of the National Health Act 1953 by the Australian Government, aiming to streamline the process of approving pharmacists by setting clear and consistent application fees. The objective was to address the need for a transparent and regulated fee structure for such applications, ensuring that the process is both efficient and financially transparent. The fees are set at $1,370 for applications requiring referral to the Australian Community Pharmacy Authority and $465 for other applications, reflecting the varying levels of assessment and review involved.

Scope and Application

The National Health (Application Fees for Pharmacist Approvals) Determination 2020 is a legislative instrument made under the National Health Act 1953. It applies to pharmacists and other relevant parties who need to submit applications for approvals under subsection 90(1) or (3) of the Act. The determination sets out the fees payable for such applications, with a fee of $1,370 for applications referred to the Australian Community Pharmacy Authority and $465 for all other applications. The legislation operates across the Commonwealth of Australia and applies to all relevant entities and persons within its jurisdiction. Any amendments or further specifications regarding the fees or application process may be made through subordinate instruments under the Act, although the primary fees remain as specified in this determination. The legislation is designed to ensure that the application process for pharmacist approvals is transparent and that there is a clear fee structure in place. The fees are intended to cover the administrative costs associated with processing applications and are subject to review and adjustment as necessary through future legislative instruments. This determination does not specify any exclusions or exemptions from the application of these fees, implying that all eligible applications are subject to the prescribed fees. The geographic and jurisdictional reach of the legislation is national, applying uniformly across all states and territories of Australia.

Key Provisions

The National Health (Application Fees for Pharmacist Approvals) Determination 2020, made under subsection 90(10) of the National Health Act 1953, outlines the fees applicable for certain applications related to pharmacist approvals under the Act. Specifically, section 4 of the Determination sets out the fees for applications under subsection 90(1) or (3) of the National Health Act 1953. If an application must be referred to the Australian Community Pharmacy Authority under subsection 90(3A) of the Act, the fee is $1,370. For all other applications, the fee is $465. The Determination imposes clear financial obligations on entities and individuals submitting applications for pharmacist approvals. The fee structure ensures that the necessary funds are provided to cover the administrative costs associated with processing these applications. The fees must be paid at the time of application submission, and failure to do so may result in the application being considered incomplete and thus not processed. The obligations extend to ensuring that applicants are aware of the correct fee amount based on whether their application is referred to the Authority or not, as outlined in section 4 of the Determination. Breaching the requirements of this Determination, such as failing to pay the correct fee or submitting an incomplete application, may have legal consequences. While the Determination itself does not explicitly state penalties for non-compliance, failure to adhere to the application process, including fee payment, could lead to the application being rejected, which may result in delays or denial of the desired pharmacist approval. Additionally, if the non-compliance is part of a broader pattern of disregard for legislative requirements, it could potentially lead to more severe legal actions under the overarching National Health Act 1953. For the most accurate and comprehensive understanding of potential penalties, reference to the primary Act and any relevant case law or regulatory guidelines would be necessary.
