Overview

The National Health Act 1953 was enacted to provide a framework for the administration of national health services, including the Pharmaceutical Benefits Scheme (PBS). This legislation was introduced to address the need for a structured approach to ensuring that medications are accessible and affordable to the Australian public. The Act was passed by the Commonwealth Parliament and its policy objective is to facilitate equitable access to essential medicines by subsidising the cost of prescription drugs listed on the PBS. In accordance with the Act, the Minister for Health and Ageing, through a delegate, has the authority to amend the list of subsidised medicines based on recommendations from the Pharmaceutical Benefits Advisory Committee. This particular legislative instrument, F2008B00055, specifies a declaration made under subsection 85(2AA) of the National Health Act 1953, which details the removal of certain drugs and medicinal preparations from the PBS, effective from 1 November 2002.

Scope and Application

The Pharmaceutical Benefits Declaration under Subsection 85 (2AA) of the National Health Act 1953 applies to specific drugs and medicinal preparations listed in the Schedule to the Declaration, which are deemed to cease being subject to Part VII of the National Health Act 1953. This Act operates at the Commonwealth level, thereby influencing the pharmaceutical benefits provided under the national health scheme. The geographical reach of the Act is across Australia, ensuring a uniform application of the provisions across the nation. The Declaration specifically affects the listed drugs and medicinal preparations, removing their eligibility for benefits under the Pharmaceutical Benefits Scheme (PBS). The exclusions in this context are the drugs and preparations specified in the Schedule, which are no longer considered for benefits as per the Act. While the primary legislation sets out the overarching framework, subordinate instruments and regulations may further define and refine the application of these provisions, thus extending or restricting their scope as necessary.

Key Provisions

The key operative sections of this legislative instrument, F2008B00055, are found under subsection 85(2AA) of the National Health Act 1953. This declaration, made by Brett Anthony Lennon, an Assistant Secretary of the Pharmaceutical Benefits Branch and a delegate of the Minister for Health and Ageing, specifies certain drugs and medicinal preparations that will cease to be subject to Part VII of the National Health Act 1953. The specified drugs in the Schedule to the Declaration include "Aminogran Food Supplement," Hydrochlorothiazide, Ranitidine Bismuth Citrate and Clarithromycin and Amoxycillin Trihydrate, and Tenoxicam. This cessation of application under Part VII comes into effect on 1 November 2002, as stipulated in the Declaration. The Act imposes certain obligations and requirements on the parties it governs. Firstly, the declaration is made pursuant to advice obtained from the Pharmaceutical Benefits Advisory Committee, which must be obtained in accordance with subsection 85(2AB) of the National Health Act 1953. Brett Anthony Lennon, as a delegate of the Minister for Health and Ageing, has the authority to make this declaration. The Schedule lists the specific drugs and preparations that will no longer be subject to the Pharmaceutical Benefits Scheme (PBS) provisions, thereby impacting their eligibility for subsidies and coverage under the Act. In terms of offences, penalties, or consequences for breach, the legislative instrument does not explicitly state any specific offences or penalties for non-compliance with the cessation of the listed drugs under Part VII of the National Health Act 1953. However, the consequences of this declaration would primarily affect the pharmaceutical industry, healthcare providers, and patients by altering the eligibility of these drugs for subsidies and coverage under the PBS. This change might also influence pricing, availability, and access to these medications within the Australian healthcare system.
