Overview

The National Disability Insurance Scheme (Approved Quality Auditors Scheme) Amendment Guidelines 2019 were made by Graeme Head, the Commissioner of the NDIS Quality and Safeguards Commission, under subsection 181D(2) of the National Disability Insurance Scheme Act 2013. The purpose of these guidelines is to amend the existing guidelines concerning the approved quality auditors within the NDIS framework, addressing various aspects such as the definition of terms, roles, and responsibilities of auditors and audit teams, and the conduct of audits. The guidelines aim to ensure that the auditing process within the NDIS is conducted effectively, efficiently, and in compliance with the required standards, thereby enhancing the quality and reliability of the NDIS services provided to participants.

Scope and Application

The National Disability Insurance Scheme (Approved Quality Auditors Scheme) Amendment Guidelines 2019 apply to approved quality auditors operating within the scope of the National Disability Insurance Scheme (NDIS) in Australia. These guidelines amend the National Disability Insurance Scheme (Approved Quality Auditors Scheme) Guidelines 2018, providing clarity and adjustments to the roles, responsibilities, and standards for auditors and audit teams involved in the assessment and certification of NDIS providers. The guidelines are applicable nationally, as they are issued under the National Disability Insurance Scheme Act 2013. The amendments cover various aspects such as the definition of terms, roles of auditors and audit teams, and the conduct of different types of audits, including provisional, surveillance, and verification audits. Specific exclusions and thresholds are set out within the guidelines, detailing which NDIS providers are exempt from certain audit requirements based on their registration classes and the nature of services they provide. The application of these guidelines can be further extended or restricted through subordinate instruments, which may provide additional specifications or clarifications to the guidelines.

Key Provisions

The National Disability Insurance Scheme (Approved Quality Auditors Scheme) Amendment Guidelines 2019 (the Guidelines) introduce significant changes to the National Disability Insurance Scheme (Approved Quality Auditors Scheme) Guidelines 2018. These amendments include a range of new definitions and provisions that alter the scope and execution of audits within the NDIS framework. For instance, the term "auditor" now specifically refers to a person engaged by an approved quality auditor to conduct an audit, excluding consumer technical experts (Schedule 1, item 2). Additionally, the Guidelines introduce the concept of "technical expert," defined as a person providing specific knowledge or expertise to the audit team, who is not an auditor (Schedule 1, item 11). Furthermore, the Guidelines mandate that certification or recertification audits must be conducted by an audit team consisting of at least two auditors, including auditor-in-training (Schedule 1, item 17). Other types of audits, such as provisional, surveillance (monitoring), and verification audits, require at least one auditor, with the exception of verification audits which do not need an audit team leader (Schedule 1, items 18 and 19). The Guidelines impose several obligations on approved quality auditors. These include ensuring that all auditors, excluding consumer technical experts, have completed relevant courses and possess the necessary disability and cultural awareness (Schedule 1, item 30). Approved quality auditors must also ensure that all auditors and personnel comply with the Code of Conduct and that all auditors and personnel are provided with relevant information from the Commission in a timely manner (Schedule 1, items 34 and 40). Additionally, approved quality auditors must ensure that all auditors and personnel, including consumer technical experts and technical experts, comply with the Code of Conduct as outlined in Annex A (Schedule 1, item 34). The Guidelines also detail the responsibilities of auditors within the audit team, emphasizing that these responsibilities should be proportionate to the size and scale of the NDIS provider and the scope and complexity of the services being or to be delivered (Schedule 1, item 19). Under the Guidelines, there are no explicit criminal or civil penalties for non-compliance with the provisions. However, failure to comply with these Guidelines could potentially lead to the revocation of an approved quality auditor’s accreditation, which would prevent them from conducting audits under the NDIS. This outcome would effectively prevent the non-compliant entity from participating in the NDIS quality assurance framework, thus impacting their ability to provide services within the scheme. Additionally, the NDIS Quality and Safeguards Commission retains the authority to take enforcement actions against non-compliant auditors and approved quality auditors, which could include further regulatory sanctions.
