Overview

The National Class 3 Vehicle Carrier Exemption Notice 2026 (No. 1) was enacted to address the need for specific exemptions from the dimension requirements of the Heavy Vehicle (Mass, Dimension and Loading) National Regulation (the Regulation) for class 3 heavy vehicles, particularly those used as vehicle carriers. This notice replaces and revokes the National Class 3 Vehicle Carrier Exemption Notice 2025 (No. 1). It was made under the Heavy Vehicle National Law (HVNL) and authorises the exemption of certain vehicle carriers from compliance with certain mass or dimension requirements, subject to specified conditions. This notice applies in New South Wales, Queensland, South Australia, and Tasmania, providing exemptions to B-double vehicle carriers and eligible truck and trailer combinations under specific conditions. The primary objective of this notice is to facilitate the movement of these vehicles while ensuring safety and compliance with specified routes and conditions.

Scope and Application

The National Class 3 Vehicle Carrier Exemption Notice 2026 (No. 1) applies to certain Class 3 heavy vehicles, specifically vehicle carriers that are B-doubles in New South Wales, Queensland, South Australia, and Tasmania, and eligible truck and trailer combinations in Queensland. This notice provides exemptions from specific dimension requirements under the Heavy Vehicle (Mass, Dimension and Loading) National Regulation, contingent upon compliance with the conditions outlined in the schedules of this notice. It is important to note that the exemption applies only within the specified areas or routes detailed in the schedules and during the stated hours of operation. Furthermore, vehicle carriers higher than 4.3 metres but not exceeding 4.6 metres must ensure sufficient height clearance to avoid striking or damaging any road infrastructure. The notice revokes and replaces the National Class 3 Vehicle Carrier Exemption Notice 2025 (No. 1) and is made under the Heavy Vehicle National Law, with a commencement date of 1 August and an expiry date of 9 February 2029. The notice also includes various conditions and restrictions for the use of specified routes and areas, as well as requirements for driver assessments and continual monitoring of road clearances.

Key Provisions

The National Class 3 Vehicle Carrier Exemption Notice 2026 (No.1) is designed to exempt certain categories of class 3 heavy vehicles from specific dimension requirements under the Heavy Vehicle (Mass, Dimension and Loading) National Regulation (the Regulation) (sections 117 and 23). This notice replaces the National Class 3 Vehicle Carrier Exemption Notice 2025 (No.1). It applies to vehicle carriers that are B-doubles in New South Wales, Queensland, South Australia and Tasmania, and eligible truck and trailer combinations in Queensland. It exempts B-doubles and eligible truck and trailer combinations from certain dimension limits set out in the Regulation (section 3(1)(d) and section 3(1)(a)). The notice is applicable only in the areas or routes, and during the hours specified in the schedules attached to this notice. The schedules detail the specific routes and conditions under which the exemptions are granted, including restrictions on the height of the vehicles and the routes they can travel on. The notice imposes several obligations on the parties it governs. Firstly, vehicle carriers must adhere to the conditions specified in the schedules, including the routes they can travel on and the times they can operate. For example, in New South Wales, B-doubles can only travel on routes that are approved on both the relevant B-double network map and the 4.6m High Vehicle Network layer on the NHVR National Network Map. Secondly, drivers of vehicle carriers that are higher than 4.3m must assess the suitability of roads before operating on them to ensure sufficient height clearance exists. This is to prevent the vehicle from striking or damaging any road infrastructure. Furthermore, vehicle carriers must comply with any conditions applicable to the routes or areas described in the schedules, as well as the conditions set out in other relevant documents, such as the National Class 2 B-double Authorisation Notice. Failure to comply with the conditions set out in the notice may result in civil or criminal consequences. The specific penalties for breaches of the notice are not detailed in the notice itself, but breaches of the Heavy Vehicle National Law (HVNL) generally may result in significant penalties. For example, under the HVNL, a person who contravenes a provision of the law can be issued with a penalty notice with a maximum penalty of $1,550 for an individual and $7,750 for a body corporate. More serious offences can result in fines of up to $165,000 for an individual and $825,000 for a body corporate, and/or imprisonment for up to five years. Additionally, under the HVNL, a court may disqualify a person from holding or obtaining a driver licence, a heavy vehicle operator licence or a heavy vehicle national law registration certificate for a period of up to five years.
