Overview

The National Class 3 Vehicle Carrier Exemption Notice 2024 (No. 1) was enacted to address the specific dimensional limitations for certain class 3 heavy vehicles in various Australian states, as stipulated under the Heavy Vehicle (Mass, Dimension and Loading) National Regulation. This Notice, made under section 117 of the Heavy Vehicle National Law (HVNL), exempts certain vehicle carriers from specified dimension requirements of the Regulation, subject to specific conditions. The Notice applies to vehicle carriers that are B-doubles in New South Wales, Queensland, South Australia, and Tasmania, and to eligible truck and trailer combinations in Queensland. It exempts these vehicles from certain dimension limits while imposing conditions related to the areas or routes where these vehicles can operate, as well as specific hours and days of operation. This legislation aims to facilitate smoother interstate transport operations for these vehicles, while ensuring compliance with safety and regulatory standards. The Notice is overseen by the National Heavy Vehicle Regulator, and it is designed to address the practical challenges faced by operators of vehicle carriers that transport vehicles across multiple decks. By providing exemptions and setting out the conditions for such exemptions, the Notice aims to balance operational efficiency with safety and infrastructure protection. This Notice is set to commence on 10 February 2024 and will expire on 9 February 2029, providing a clear framework within which these vehicles can operate across different states.

Scope and Application

The National Class 3 Vehicle Carrier Exemption Notice 2024 (No. 1) applies to specified categories of Class 3 heavy vehicles within New South Wales, Queensland, South Australia, and Tasmania, providing exemptions from certain dimension requirements of the Heavy Vehicle (Mass, Dimension and Loading) National Regulation. Specifically, this Notice exempts vehicle carriers, which are either B-doubles or eligible truck and trailer combinations, from certain dimension limits under the Regulation, provided they adhere to the conditions outlined in the Notice. The exemption applies to B-doubles in New South Wales, Queensland, South Australia, and Tasmania, and to eligible truck and trailer combinations in Queensland. The Notice mandates compliance with specific conditions regarding the routes, hours of operation, and additional stipulations as detailed in the Schedules, ensuring that these vehicles meet all applicable regulations outside of the exempted dimension requirements. The Notice further details the specific areas or routes, hours of operation, and additional conditions for each state, ensuring clarity and adherence to the Notice's provisions.

Key Provisions

The National Class 3 Vehicle Carrier Exemption Notice 2024 (No. 1) is a legislative instrument under section 117 of the Heavy Vehicle National Law (HVNL) which provides exemptions from certain dimension requirements for specified class 3 heavy vehicles. The Notice exempts certain vehicle carriers from the dimension limits prescribed in the Heavy Vehicle (Mass, Dimension and Loading) National Regulation, provided they meet the conditions outlined in the Schedules attached to the Notice. These exemptions apply to B-double vehicles and truck and trailer combinations in New South Wales, Queensland, South Australia, and Tasmania. The Notice provides detailed conditions for the use of these exempted vehicles, including specific routes and areas they can travel on, as well as operational restrictions such as hours of operation and height clearances. The Notice imposes several obligations on the parties it governs. Firstly, vehicle carriers must comply with the conditions specified in the Schedules attached to the Notice, including adhering to the specified routes and areas, operating within the permitted hours, and ensuring compliance with any conditions applicable to the routes or areas described in the Schedules. For B-double vehicles that are higher than 4.3 metres, the Notice requires drivers to assess the suitability of roads before operation to ensure sufficient height clearance, and to continually monitor the roads to ensure the vehicle does not strike or damage any road infrastructure. Additionally, the Notice mandates that vehicles must not be carried on an upper deck unless each deck below is fully loaded. These conditions are intended to ensure the safe and compliant operation of exempted vehicles on public roads. Failure to comply with the conditions outlined in the Notice may result in various penalties and consequences. While the Notice does not specify maximum penalties, breaches of the Heavy Vehicle National Law or the Heavy Vehicle (Mass, Dimension and Loading) National Regulation generally may attract penalties, including fines and potential criminal charges. The exact penalties would depend on the specific breach and the applicable legislation. It is important for operators to adhere strictly to the conditions set out in the Notice to avoid any potential legal repercussions.
