Overview

The National Class 3 Supplementary Access (Western Australia Assistance) Exemption Notice 2022 (No. 2) was enacted to provide critical assistance to Western Australia during a period when regular rail and road freight routes were disrupted by natural disaster. This exemption notice, made under the authority of the Heavy Vehicle National Law, aims to enhance freight capacity by allowing access for Class 3 heavy vehicles, specifically road trains up to 53.5 meters in length, between South Australia and Western Australia. It revokes and replaces the previous exemption notice issued in 2022, extending the exemption period and providing additional access for A-doubles towing a converter dolly on prescribed roads. This exemption applies to eligible vehicles that meet specific conditions, including compliance with conditional mass limits and adherence to road, travel, and vehicle conditions as outlined in the notice. The exemption facilitates the movement of essential goods, ensuring continuity in the supply chain during critical times of need.

Scope and Application

The National Class 3 Supplementary Access (Western Australia Assistance) Exemption Notice 2022 (No. 2) applies to Class 2 road trains, specifically those that are not more than 53.5 metres in length and meet the definition of a Type-2 road train under the National Class 2 Road Train Authorisation Notice 2020, that are transporting goods from South Australia to Western Australia or vice versa along the specified routes. The Notice provides exemptions from certain axle mass requirements under the Heavy Vehicle (Mass, Dimension and Loading) National Regulation, subject to specified conditional mass limits. The exemption applies to the specified routes only, which are set out in Schedule 1 of the Notice, and include roads from Port Augusta to the Western Australian border and from Whyalla Barson to the Western Australian border. The Notice also applies to Class 2 road trains that are compliant A-doubles towing a converter dolly, with access provided on prescribed roads set out in Table 3 of Schedule 1. The Notice does not apply to any heavy vehicles that do not meet the specified conditions.

Key Provisions

The main operative sections of the Notice (sections 1–13) establish the parameters for the exemption of certain axle mass requirements for Class 3 heavy vehicles operating between South Australia and Western Australia during a period of disruption to regular freight routes due to natural disaster. Specifically, section 7 clarifies the eligibility criteria for vehicles under the Notice, which includes Class 2 road trains that do not exceed 53.5m in length and are operating on the specified routes (section 10). Section 8 exempts eligible vehicles from certain mass requirements under Schedule 1 of the Heavy Vehicle (Mass, Dimension and Loading) National Regulation, subject to the conditional mass limits outlined in section 9. These conditional mass limits specify the maximum allowable mass for tandem and tri-axle groups, which are 17t and 22.5t respectively. Section 11 requires that vehicles with axle groups exceeding these mass limits must be fitted with certified road-friendly suspension systems, while section 12 mandates that drivers of vehicles with tri-axle groups exceeding regulation mass limits must hold mass management accreditation. The Notice imposes several obligations and requirements on parties it governs. Eligible vehicles must adhere to the specified mass limits, comply with road, travel, and vehicle conditions as per the Heavy Vehicle National Law (sections 160–162), and ensure that their suspension systems are functioning correctly. Additionally, eligible vehicles must follow the specified routes either from the start point to the end point or on a return journey, as outlined in section 10. The Notice also specifies that any mass management accreditation and certified suspension systems must be valid and operational at all times when the vehicle is in operation under the Notice. The Notice does not explicitly outline specific offences, penalties, or consequences for breach within its text. However, any breach of the conditions set out in the Notice may be subject to the general provisions of the Heavy Vehicle National Law, which could include penalties for non-compliance with road, travel, and vehicle conditions. The penalties for such breaches can vary and may include fines, demerit points, or other enforcement actions as determined by the relevant authorities. Additionally, failure to comply with the specified mass limits or suspension system requirements could lead to enforcement actions under the HVNL.
