Overview
The National Class 2 Heavy Vehicle Controlled Access Bus Authorisation (Notice) 2014 (No. 1) and National Class 3 Heavy Vehicle Controlled Access Bus Rear Overhang Dimension Exemption (Notice) 2014 (No. 1) Amendment Notice (No. 1) 2014 was enacted to amend the original notices regarding the authorisation and exemption for controlled access buses. This legislation was introduced to address the need for updating and fine-tuning the regulations surrounding the use of heavy vehicles, specifically Class 2 and Class 3 buses, on designated roads and routes within Australia. The notice was made under Section 138 of the Heavy Vehicle National Law, as in force in each state and territory, and Section 23 of Schedule 1 to the Heavy Vehicle National Law. This amendment was authorised by Sal Petroccitto, delegate of the National Heavy Vehicle Regulator, and aims to provide clearer guidelines and conditions for the use of controlled access buses on specified roads and during certain hours.
The enactment body responsible for this notice is the Parliament of Australia, which enacts legislation to regulate heavy vehicles across the nation. The policy objective behind this amendment is to ensure safer and more efficient transportation of passengers using controlled access buses, while also addressing any gaps or issues that may have arisen since the original notices were published. By providing updated authorisations and exemptions, the legislation seeks to improve road safety, reduce congestion, and streamline the operation of heavy vehicles within Australia.
Scope and Application
The National Class 2 Heavy Vehicle Controlled Access Bus Authorisation (Notice) 2014 (No.1) and National Class 3 Heavy Vehicle Controlled Access Bus Rear Overhang Dimension Exemption (Notice) 2014 (No.1) Amendment Notice (No.1) 2014 applies to specified heavy vehicles, namely Class 2 and Class 3 controlled access buses, in the context of the Heavy Vehicle National Law as it operates across each state and territory in Australia. This legislation allows for the authorisation of certain heavy vehicles to operate in designated areas or routes during specified hours and subject to particular conditions. The notice is applicable to entities and individuals operating these vehicles, ensuring compliance with the prescribed authorisations and exemptions regarding vehicle dimensions. The notice extends its jurisdiction across the entire nation, reflecting the unified approach under the Heavy Vehicle National Law. It is pertinent to note that this notice includes specific exclusions and conditions as outlined in Schedule 1, which details the roads, starting and finishing points, and operational constraints for the authorised buses.
Key Provisions
This amendment notice pertains to the National Class 2 Heavy Vehicle Controlled Access Bus Authorisation (Notice) 2014 (No.1) and the National Class 3 Heavy Vehicle Controlled Access Bus Rear Overhang Dimension Exemption (Notice) 2014 (No.1), as amended by the National Class 2 Heavy Vehicle Controlled Access Bus Authorisation (Notice) 2014 (No.1) and National Class 3 Heavy Vehicle Controlled Access Bus Rear Overhang Dimension Exemption (Notice) 2014 (No.1) Amendment Notice (No.1) 2014. This notice is designed to adjust the authorisations for certain heavy vehicles to operate on specific roads during designated times and under certain conditions. The primary changes introduced by this amendment are detailed in Schedule 1, which outlines the new controlled access bus routes, road numbers, starting and finishing points, and the conditions under which these buses can operate (Schedule 1, Table 1).
The obligations imposed by this notice include adherence to the specified routes, road names, starting and finishing points, and operating hours as outlined in Schedule 1. Operators of the heavy vehicles must ensure that their operations comply with these parameters and any additional conditions stipulated in the notice. This includes ensuring that the vehicles meet any dimensional requirements and other regulatory standards applicable to controlled access buses. Additionally, operators must be aware of and comply with any local regulations or additional conditions imposed by state or territory authorities.
Failure to comply with the provisions of this notice may result in legal consequences. While the notice itself does not specify penalties, breaches of the Heavy Vehicle National Law, under which this notice is made, can lead to civil or criminal penalties. The specific penalties depend on the nature and severity of the breach but can include fines and, in more serious cases, imprisonment. The exact penalties would be determined by the courts based on the relevant provisions of the Heavy Vehicle National Law and any applicable state or territory laws. It is essential for operators to familiarise themselves with both the notice and the broader legal framework to avoid any potential penalties.
