Overview
The Heavy Vehicle National Law (HVNL) National Class 2 Heavy Vehicle B-double Authorisation (Notice) 2014 (No. 2) Amendment Notice (No. 3) was enacted in 2014 to address the need for specific authorisation of B-double heavy vehicles in certain areas and on specific routes during designated hours. This legislation was introduced to ensure the safe and efficient movement of heavy vehicles while mitigating potential risks associated with their operation. The notice is made under the authority of section 138 of the HVNL and was enacted by the delegate of the National Heavy Vehicle Regulator, Sal Petroccitto. The primary objective of this notice is to regulate the use of B-double heavy vehicles in specified areas or on stated routes, under certain conditions and during designated times, ensuring compliance with the Heavy Vehicle (Mass, Dimension and Loading) National Regulation.
This amendment notice revokes a previous notice to correct its declaration while maintaining the same authorisations and conditions. The notice specifies various conditions under which B-double heavy vehicles may operate, including restrictions on access points, prohibitions on loading and unloading on public roads, and requirements for suitable access on properties. The notice is effective from its date of publication in the Commonwealth Gazette and expires on 9 February 2019. This notice is intended to provide clarity and ensure that heavy vehicle operations are conducted safely and in accordance with the relevant regulations.
Scope and Application
This Notice, made under section 138 of the Heavy Vehicle National Law (HVNL), authorises the use of specified class 2 heavy vehicles that are B-doubles within stated areas or on stated routes, during stated hours of specified days and subject to the conditions set out in this Notice. The Notice applies to the persons or entities that operate the B-doubles in accordance with the specific conditions outlined. The geographic reach of this Notice is governed by the HVNL, which applies across the Commonwealth of Australia. This Notice revokes the earlier National Class 2 Heavy Vehicle B-double Authorisation (Notice) 2014 (No. 2) Amendment Notice (No. 2) and corrects the declaration. The Notice specifies the types of B-doubles permitted, the roads and areas they can access, the conditions of travel, and the compliance requirements under the Heavy Vehicle (Mass, Dimension and Loading) National Regulation. The Notice is effective from its publication date and expires on 9 February 2019, unless otherwise altered by subordinate instruments under the HVNL.
Key Provisions
The primary sections of this Notice, particularly those in Schedule 1, authorise the use of B-double heavy vehicles within specified areas or on specified routes, under specific conditions and during stated hours of specific days (section 7). This authorisation is explicitly for class 2 heavy vehicles that are B-doubles, which are vehicles consisting of a prime mover towing a semi-trailer with a dolly carrying another semi-trailer. The Notice sets out the conditions, including the maximum height and length of the B-doubles, as well as specific route restrictions and operational requirements, such as the direction of entry and exit from properties in certain industrial estates and the prohibition of loading or unloading on public roads without separate approval.
Entities and individuals governed by this Notice must adhere to the stringent conditions outlined in the Notice. This includes ensuring that the B-doubles do not exceed the specified height and length, and that all operations, such as entering and exiting properties and loading or unloading, comply with the stated conditions. The Notice mandates that suitable access must be available for vehicle turning and that no access is permitted on certain roads without prior approval. These obligations are critical for maintaining safety and compliance with national heavy vehicle regulations.
Failure to comply with the provisions of this Notice can result in severe consequences. Under section 138 of the Heavy Vehicle National Law (HVNL), breaches of this Notice are considered offences. The penalties for such breaches can be substantial, potentially including fines and other penalties as determined by a court. While the specific maximum penalties are not detailed in this Notice, it is understood that penalties for non-compliance with heavy vehicle regulations can be significant, reflecting the importance of adhering to these safety and operational standards.
In summary, the Notice provides a comprehensive framework for the authorised use of B-double heavy vehicles in specified areas and under specific conditions. It imposes clear obligations on operators and entities to ensure compliance with safety and operational requirements. Non-compliance can lead to serious penalties, underscoring the importance of adhering to the Notice’s provisions. The Notice thus serves to regulate and control the use of B-double heavy vehicles in a manner that prioritises safety and compliance with national standards.
