Overview
The National Class 2 Heavy Vehicle B-double Authorisation (Notice) 2014 (No. 2) Amendment Notice (No. 2), enacted in 2014, was introduced to address the need for regulating the use of B-double vehicles in specific areas and on certain routes, ensuring that these vehicles are used under strict conditions to maintain safety and compliance with national heavy vehicle regulations. This notice was made under section 138 of the Heavy Vehicle National Law (HVNL) and is an amendment to the existing authorisation notice, updating the conditions and areas where B-double vehicles can operate. The notice was issued by the National Heavy Vehicle Regulator, with the aim of ensuring that the use of B-double vehicles is managed effectively, reducing risks associated with their operation on public roads.
The notice provides specific authorisation for the use of B-doubles in designated areas or on certain routes, during specified hours and days, and outlines the conditions under which these vehicles can be operated. It emphasises compliance with the Heavy Vehicle (Mass, Dimension and Loading) National Regulation, particularly for B-doubles longer than 25m, to ensure that operations do not compromise road safety or infrastructure integrity. This amendment is significant for operators and local authorities, as it directly impacts how B-double vehicles can be utilised in defined locations, subject to the regulatory framework designed to protect public safety and maintain the integrity of the national road network.
Scope and Application
The National Class 2 Heavy Vehicle B-double Authorisation (Notice) 2014 (No. 2) Amendment Notice (No. 2) serves to regulate the use of B-double heavy vehicles, which are vehicles composed of a prime mover towing a semi-trailer with a dolly attached, within specified areas, on designated routes, and during particular hours on certain days. This notice applies to all entities or individuals operating B-double heavy vehicles within the jurisdictional scope of the Heavy Vehicle National Law (HVNL). The authorisation extends to the areas and routes listed in Schedule 1 of the notice, with conditions that include restrictions on access to certain roads, requirements for the direction of travel within industrial estates, and prohibitions against loading or unloading on public roads without prior approval. The notice is effective from its publication in the Commonwealth Gazette and will remain in force until 9 February 2019. Operators of B-double vehicles must also comply with the Heavy Vehicle (Mass, Dimension and Loading) National Regulation, particularly where the vehicle exceeds 25 metres in length. This notice does not explicitly mention any exclusions or exemptions, nor does it indicate that its application is extended or restricted through subordinate instruments.
Key Provisions
The main operative sections of the notice (sections 2 to 6) provide the legislative framework and details regarding the authorisation of B-double heavy vehicles under the Heavy Vehicle National Law (HVNL). Section 2 specifies the authority under which this notice is made, while section 3 indicates the commencement date of the notice, which is the date of its publication in the Commonwealth Gazette. Section 4 sets the expiry date of the notice as 9 February 2019, and section 5 provides a title for the notice, allowing it to be cited appropriately. Section 6 details the amendments to Schedule 1, Appendix 1 of the National Class 2 Heavy Vehicle B-double Authorisation (Notice) 2014 (No. 2). The declaration by Angus Draheim, as a delegate of the National Heavy Vehicle Regulator, authorises the use of specified B-double heavy vehicles in stated areas or routes during stated hours and under certain conditions.
The obligations imposed by this notice primarily pertain to the authorisation of B-double heavy vehicles and the conditions under which they may be used. The notice mandates that B-doubles must comply with specified conditions, such as the prohibition of 25/26m B-double access on certain roads, and requires heavy vehicles to enter and leave properties in Thornton Industrial Estate in a forward direction. Additionally, the notice prohibits loading and unloading on public roads in Thornton Industrial Estate without separate approval from the Road Manager (Maitland City Council). Operators are also required to ensure that suitable access is available for vehicle turning on the properties in Thornton Industrial Estate, in accordance with the development approvals. Furthermore, B-doubles must adhere to the Heavy Vehicle (Mass, Dimension and Loading) National Regulation, particularly in cases where the B-double exceeds 25 meters in length.
The notice does not explicitly outline specific offences, penalties, or civil/criminal consequences for breaches of its conditions. However, non-compliance with the terms of the authorisation or the associated regulations could potentially lead to enforcement actions under the Heavy Vehicle National Law (HVNL) and other relevant legislation. Violators may face fines, penalties, or other legal consequences as prescribed by the applicable laws. The specific penalties would depend on the nature and severity of the breach, as well as the provisions of the Heavy Vehicle National Law and any related regulations or by-laws.
