Overview

The Heavy Vehicle National Law National Class 2 B-double Authorisation Notice 2024 (No.1) was enacted to address the need for authorised use of class 2 heavy vehicles that are B-doubles, ensuring they meet specific conditions for mass limits, access, and operation across various jurisdictions. This notice is made under section 138 of the Heavy Vehicle National Law (HVNL), which provides the National Heavy Vehicle Regulator with the power to authorise the use of specified categories of class 2 heavy vehicles. The notice commenced on 1 February 2024 and will expire on 31 January 2029. It applies to all participating jurisdictions, granting general access to eligible vehicles that meet the specified conditions, including mass limits, hours of operation, drive group restrictions, and specific route access. Each jurisdiction has additional conditions and restrictions outlined in the schedules attached to the notice. The policy objective is to ensure that B-double vehicles operate safely and efficiently while complying with national and state regulations.

Scope and Application

The Heavy Vehicle National Law National Class 2 B-double Authorisation Notice 2024 (No. 1) authorises the use of Class 2 B-double heavy vehicles across participating jurisdictions, including the Australian Capital Territory, New South Wales, Queensland, South Australia, Tasmania, and Victoria. This authorisation applies to Class 2 B-double vehicles that meet specific conditions related to axle spacing and mass limits, as well as other specified conditions such as vehicle length restrictions and drive group limitations. The Notice allows eligible vehicles, which comply with the notice's conditions and relevant schedules, to access certain roads and routes within each jurisdiction. However, eligible vehicles must also adhere to road, vehicle, and travel conditions that apply to the specified networks. The Notice operates under the authority of section 138 of the Heavy Vehicle National Law, and it includes specific provisions for each participating jurisdiction, detailing the conditions for access to particular road networks and any additional restrictions that may apply.

Key Provisions

The main operative sections of the National Class 2 B-double Authorisation Notice 2024 (No. 1) (the Notice) pertain to the authorisation of the use of Class 2 B-double heavy vehicles (sections 1 and 2), the conditions under which these vehicles may qualify for general access (section 8), and the specific conditions regarding hours of operation, drive group restrictions, and authorisation to access stated areas or routes (sections 9, 10, and 11). This authorisation is given under section 138 of the Heavy Vehicle National Law (HVNL). The Notice commences on 1 February 2024 and expires on 31 January 2029. It applies in all participating jurisdictions, subject to conditions specified in the body of the Notice and the conditions of the Schedule relevant to each jurisdiction. The Notice imposes several obligations and requirements on the parties it governs. Firstly, to qualify for general access, eligible vehicles must meet the axle spacing mass limits specified in Table 1 (section 8(1)). If the vehicle is a complying steer axle vehicle, an additional 0.5t may be added to the mass limit (section 8(2)). Eligible vehicles may also apply Concessional Mass Limits if they comply with the conditions of Schedule 2 of the Heavy Vehicle (Mass, Dimension and Loading) National Regulation (section 8(3)). Vehicles may use areas or routes at any time unless specified otherwise as a travel condition on the stated map or stated list (section 9). Additionally, eligible vehicles must not have a drive axle group with more than two axles in contact with the ground (section 10(1)). Furthermore, eligible vehicles must comply with road, vehicle, and travel conditions as specified for the routes and areas set out on the map (section 11(3)). Failure to comply with the conditions of the Notice may result in civil or criminal penalties. While the Notice does not explicitly state the penalties, violations of the HVNL or its regulations typically involve infringement notices for civil penalties and court proceedings for criminal penalties. The specific penalties can vary depending on the nature and severity of the breach but may include fines up to several thousand Australian dollars for both civil and criminal offences. The exact penalties would be determined according to the relevant provisions of the HVNL and other applicable laws.
