Overview

The Australian Capital Territory (Planning and Land Management) Act 1988, enacted by the Australian Capital Territory, addresses planning and land management within the ACT. This piece of legislation allows for the National Capital Plan to be amended to meet evolving needs of the territory's development and management. Amendment 32 of the National Capital Plan, approved under Section 19 of the Act, was introduced to address specific boundary changes of the Australian National University. The objective of these changes is to ensure that the land use categories and designated areas accurately reflect the current and future requirements of the area, including the designation of certain areas as "Community Facility" to better serve the community's needs. The amendment, approved by Ian Douglas Macdonald, Minister for Regional Services, Territories and Local Government, was aimed at excluding certain parts of Hutton Street, Kingsley Street City, and Block 2 Section 63 Acton from the Designated Area, while including Blocks 13 and 16 Section 28 City with a Land Use Category of "Community Facility." This amendment reflects a policy objective to optimise the use of land within the National Capital Plan, ensuring it aligns with the strategic goals of the Australian Capital Territory's planning framework.

Scope and Application

The Australian Capital Territory (Planning and Land Management) Act 1988 provides the legislative framework for the planning and management of land within the Australian Capital Territory. This Act applies to the regulation and control of land use within the territory, ensuring that development and land management are conducted in a manner that is consistent with the overarching goals and objectives of the National Capital Plan. The Act applies to various entities and individuals who are involved in the planning, development, and management of land within the territory. This includes local government authorities, the National Capital Authority, and private landowners. The Act also applies to the conduct of planning processes, including the preparation, approval, and amendment of plans and zoning regulations. The geographic reach of this Act is confined to the Australian Capital Territory, governing all land management and planning activities within this specific jurisdiction. Amendment 32 of the National Capital Plan, approved under this Act, specifically addresses the boundary changes of the Australian National University. This amendment involves the exclusion of certain streets and land parcels from the Designated Area and the inclusion of other areas with a specific land use category. The changes are geographically limited to the Central National Area, impacting parts of Acton and Canberra Central. This amendment ensures that the land use planning for these areas aligns with the strategic objectives of the National Capital Plan. The changes outlined in Amendment 32 are effective within the designated areas as per the amended figures provided, impacting land use categories and the designated areas as per the Plan.

Key Provisions

The Australian Capital Territory (Planning and Land Management) Act 1988 (referred to as the Act) includes a provision for the Minister for Regional Services, Territories and Local Government to approve amendments to the National Capital Plan. Under Section 19 of the Act, the Minister has the authority to approve changes to the plan as set out in the attached Schedule. In this instance, Amendment 32 of the National Capital Plan is approved, which includes specific boundary changes for the Australian National University (ANU). This amendment involves the exclusion of certain areas from the Designated Area and the inclusion of other areas with a designated land use category (Section 19(a), (b)). The Act imposes specific obligations on the parties involved, ensuring that any changes to the National Capital Plan are systematically and transparently managed. The Minister must review the proposed changes, ensure they align with the planning objectives of the ACT, and provide an official approval if deemed appropriate. The National Capital Authority is also involved, as they are responsible for the preparation and administration of the National Capital Plan, including ensuring that any amendments are accurately reflected in the plan’s figures and maps (Section 19(c)). Failure to comply with the provisions of the Act or the approved amendments can result in various consequences. Although the specific penalties for breaches are not detailed in the legislative instrument, breaches of planning and land management legislation typically involve administrative, civil, or criminal penalties. These may include fines, enforcement actions, or other remedies to ensure compliance with the approved plan. The severity of the penalty often depends on the nature and extent of the breach, with more significant violations potentially leading to higher fines or legal action. The approved Amendment 32 includes specific land use changes and boundary adjustments for the Central National Area, impacting areas such as part of Hutton Street, Kingsley Street City, and parts of Block 2 Section 63 Acton, while also adding Blocks 13 and 16 Section 28 City as a "Community Facility". This amendment requires the National Capital Authority to update Figure 3 Designated Areas, Figure 4 Central National Area Key Map, and Figure 9 Central National Area (Acton and Canberra Central (part)) to reflect these changes accurately. Any non-compliance with these amendments could lead to the aforementioned penalties and enforcement actions to uphold the integrity of the National Capital Plan.
